BASIC PURPOSE

Positions in this job family are assigned responsibilities involving the examination, investigation and licensing of finance companies, consumer litigation funders, pawn shops, precious metal and gem dealers, health spas, rental purchase lessors, credit services organizations, mortgage brokers, mortgage lenders, mortgage loan originators, deferred deposit lenders and other creditors regarding compliance with various laws and regulations subject to the jurisdiction of the Department of Consumer Credit.

TYPICAL FUNCTIONS

The functions within this job family will vary by level, but may include the following:

  • Performs examinations and investigations of financial and other records of finance companies, consumer litigation funders, mortgage brokers, mortgage lenders, mortgage loan originators, pawn shops, precious metal and gem dealers, health spas, rental purchase lessors, credit services organizations, deferred deposit lenders and other lenders and creditors concerning individual transactions related to loans, consumer credit sales, rental purchase agreements, membership fees and other agreements.
  • Determines compliance with laws and regulations, including, but not limited to, the Uniform Consumer Credit Code and the federal Truth-in-Lending Act, concerning disclosure, annual percentage rates, refunds, delinquency and deferral fees, extension agreements, and general business practices.
  • Investigates consumer complaints and other information including, but not limited to overcharges, misleading advertising and other activities. 
  • Reviews, processes and investigates applications for licenses, which may include, but not limited to, background and credit reports.
  • Prepares affidavits, reports and other materials concerning examinations, investigations and licensing.
  • Obtains evidence for administrative hearings and testifies at administrative hearings.
  • Evaluates the financial condition of mortgage lenders.

KNOWLEDGE, SKILLS, & ABILITIES

Level I:    
Knowledge of accounting and auditing principles; of laws and regulations concerning financial institutions and other credit organizations regulated by the agency, including the Uniform Consumer Credit Code and federal Truth-in-Lending Act; of procedures for conducting interviews and investigations; and of modern office procedures, practices and equipment. Ability is required to examine financial records and other business documents; to review license applications; to conduct interviews; to analyze information and make decisions; to organize and present facts and opinions and to evaluate asset quality, capitalization, earnings and liquidity.

Level II:   
Those identified in Level I plus the ability to conduct examinations, investigations and licensing independently; and to prepare examination, investigation and licensing reports independently.

Level III:  
Those identified in Level II plus the ability to train others. 

Level IV:       
Those identified in Level III plus expert knowledge over the assigned specialization.

Level V: 
Those identified in Level IV plus the ability to plan, direct and coordinate the activities of other Consumer Credit Examiners.

LEVEL DESCRIPTORS

This job family consists of three levels which are distinguished based on the complexity of work assigned and the responsibility for the supervision of others. 

Level I:    
This is the basic level of this job family where employees are primarily responsible for performing routine entry level work in a training status to build their skills in reviewing license applications and conducting examinations and investigations of various creditors and licensees to ensure compliance with applicable laws and regulations.  In this role, employees are trained to review license applications and conduct examinations and investigations of licensee records and transactions.  Employees are also trained to prepare reports concerning license applications and examinations and investigations that have been completed.

Level II:
  
This is the career level of the job family where employees independently review license applications, conduct examinations and investigations and prepare examination, investigation and licensing reports at the full performance level.  Employees are responsible for preparing examination and investigation reports that detail alleged violations of law and/or other issues discovered during an examination or investigation.  Employees are responsible for preparing examination reports that include instructions for licensees to correct and/or address any alleged violations of law and/or any additional issues of concern.  Employees may be assigned as team leader on examination, investigation and licensing assignments.

Level III:   
This is the advanced level where employees are assigned responsibilities identified in Level II plus the supervision and training of other Consumer Credit Examiners.  Employees will continue to complete general duties and will begin training in specialized work. Employees train Consumer Credit Examiners to review license applications, conduct examinations and investigations and train Consumer Credit Examiners to prepare examination, investigation and licensing reports.  Employees supervise the work of Consumer Credit Examiners.  Employees may also be assigned as the Examiner in Charge (EIC)on examination, investigation or licensing assignments, and may be required to attend and speak at industry meetings and conduct review of examinations completed by other examiners.  Examiners at this level are expected to consistently demonstrate and conduct error-free work product.

Level IV:   
This is the specialist level where employees are assigned responsibilities identified in Level III as well as the responsibility of being the expert in their assigned specialization.  As experts, the employees act as resources for other employees, assist and advise other staff in rendering decisions regarding their specialization, and are generally responsible for ensuring that the examination manual and procedures for their specialization is consistently up to date and accurate.
 
Level V:    
This is the senior leadership level where employees are assigned responsibilities identified in Level IV as well as the responsibility of the supervision of Consumer Credit Examiners. This responsibility includes monitoring reports of examination submitted by Consumer Credit Examiners relating to the supervisor’s specialization for accuracy, advising other staff on the status of the industries pertinent to their specialization including changes in industry best practices and regulatory standards, and providing regular reports to the Chief Consumer Credit Examiner.  

MINIMUM QUALIFICATIONS

Level I:      
Education and Experience requirements at this level consist of a bachelor’s degree in business administration, accounting, finance mathematics or public administration or one year of auditing/examination experience or compliance experience with a business entity or government agency for each year of required education.

Level II:    
Education and Experience requirements at this level consist of those identified in Level I plus one year of auditing/examination experience or compliance experience with a business entity or government agency.

Level III:    
Education and Experience requirements at this level consist of those identified in Level II plus one year of auditing/examination experience or compliance experience with a business entity or government agency.

Level IV: 
Education and Experience requirements at this level consist of those identified in Level III plus one year of auditing/examination experience or compliance experience with a business entity or government agency.
 
Level V:
Education and Experience requirements at this level consist of those identified in Level IV plus one year of auditing/examination experience or compliance experience with a business entity or government agency.

SPECIAL REQUIREMENT

Applicants must be able and willing to fulfill all job-related travel normally associated with this position.
