Introduction


The Maryland Alcohol, Tobacco, and Cannabis Commission (ATCC) provides regulatory, licensing, trade practices, and oversight of Maryland’s alcohol and tobacco industries. The mission of the ATCC is to advance public safety, support economic growth, and reduce public harm by promoting the responsible sale and consumption of alcohol, tobacco, and cannabis products through consistent administration and enforcement of laws and regulations.

The Licensing, Research, and Trade Practices Division (LRTD) serves this mission by overseeing the alcohol and tobacco licensing and permitting process for entities doing business in Maryland. This division ensures that all market participants are properly licensed and compliant with state regulations, helping to create a safe and well-regulated marketplace. This position supervises the Trade Practices Unit, which is within the LRTD and conducts compliance inspections and issues guidance to alcoholic beverages licensees. This position deals with communication between industry representatives, regulators, and the ATCC.

Main Purpose of Job

This position serves as the Supervisor of the Trade Practices Unit (TPU) reporting directly to the Regulatory and Research Section Manager. TPU is responsible for educating and promoting compliance with Maryland’s alcohol and tobacco laws. This is done through compliance inspections of active licensed locations, and pre-license inspections of pending applicants. This job entails reviewing inspection reports and weighing in on alleged violations and ongoing investigations. This position is the focal point of intersecting parties, including industry members and license holders; local county liquor boards and inspectors; and Division leaders.

POSITION DUTIES

  • Plans, organizes, and directs the operation of the Trade Practices Unit.
  • Supervises three Trade Practices Investigators. Coordinates with investigators to maximize efficient inspection routes and assignments. Reviews and approves inspection reports, and coordinates with Division leadership regarding any potential violations.
  • Performs and/or supervise compliance inspections or investigations of licensed alcohol and tobacco manufacturers, wholesalers, caterers, storage warehouses, and several other ATCC issued licenses and permits.   
  • Performs and/or supervise pre-license investigations of all new alcohol and tobacco licenses and permit applications. Conduct analysis to determine if state, local and federal mandates are met.
  • Authors reports or approves reports authored by Trade Practices Unit Investigators related to pre-license inspections performed. Said reports determine the eligibility of the proposed licensed location, which directly contributes to the rejection or approval of the license.
  • Contributes to the development of the agency’s licensing and permitting platform, Salesforce. Including a new tracking inspection program.
  • Educate and ensure alcohol and tobacco license holders comply with the Maryland Alcoholic Beverages Annotated Code and Business Regulations.
  • Conducts training meetings with alcoholic beverage and tobacco license holders, and their staff, explaining the state trade practice regulations and providing copies of the pertinent regulations.
  • Meets with other State Agencies and Elected Officials, to explain and exchange information and provide help and clarification of Maryland laws and regulations relating to Alcoholic Beverages and Tobacco products.

MINIMUM QUALIFICATIONS

Candidates must have the following qualifications:

Education: Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: 6 years of administrative staff or professional work.

Notes:

1. Candidates may substitute 30 college credit hours from an accredited college or university for each year up to four years of the required experience.

2. Candidates may substitute the possession of a Bachelor's degree from an accredited college or university and two years of experience in administrative staff or professional work for the required experience.

3. Candidates may substitute the possession of a Master's degree from an accredited college or university for the required experience.

4. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer involving staff work related to the administration of rules, regulations, policy, procedures and processes, or overseeing or coordinating unit operations or functioning as a staff assistant to a higher ranking commissioned officer on a year-for-year basis for the required experience.

DESIRED OR PREFERRED QUALIFICATIONS

It is desired and preferred that candidates have the following qualifications:

4 or more years of supervisory/management experience leading a team of two or more subordinates.

3 or more years of project management experience.

3 or more years of experience as an administrator within a department, bureau, division, section, or similarly situated agency or subdivision within an organization.

2 or more years of experience with or supporting a licensing or regulatory unit of a local, state, or federal government agency.

An intermediate to advanced level of proficiency with Microsoft Office and Adobe Cloud applications. 

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.
