Main Purpose of Job
Serves
as a Lead Complaints Investigation Monitor reporting to the Chief of Family
Support and Dispute Resolution. This position works independently of the
Supervisor of Special Education Complaints Investigation and serves to monitor
Special Education Corrective Actions resulting from violations of state and
federal regulations pertaining to students with disabilities in accordance with
the Individuals with Disabilities Education Act (IDEA). The individual in this
position will work closely with Complaint Investigators, local school systems,
and parents of children with disabilities to ensure that corrective actions are
completed and the correction is maintained at the school and local school
system level, as appropriate. This work will
include ongoing monitoring and active communication with the local education
agencies and families after cases are closed to ensure that systemic and/or
school based changes are maintained. This work will include reviewing and
assisting with the implementation of professional development and reviewing
internal monitoring reports. This position will also work closely with MSDE
Complaint Investigators to determine appropriate corrective actions for
specific violations.
POSITION DUTIES
Leads the complaint
investigation monitoring of dispute determinations, investigations,
resolutions, and monitors the completion of the corrective actions required to
have been implemented over time for sustained improvement.
- Ensures corrective actions required by complaint investigations are completed as required.
- Monitors the continued implementation of the corrective actions at a student-based, school-based, or system-based level.
- Confirms the results of internal monitoring reports.
- Reviews local education data at a school and system-based level to assess the impact of any school or system-wide corrective actions.
- Works with local education agencies and other MSDE offices to revise corrective actions to achieve the desired impact and comply with state and federal regulations.
- Assists local education agencies with the development and implementation of professional development relating to corrective actions.
- Provides technical assistance to public agencies and families regarding corrective actions and matters relating to the IDEA.
- Provides technical assistance to Department staff on matters relating to corrective actions and the IDEA.
- Collaborates with other Division Branches to ensure consistent messaging of policies and case decisions.
- Maintains database and log system of complaints and supporting documents.
- Analyzes data and prepares reports reflecting complaints, compliance actions, resolution, and follow-up.
- Provides support for Department activities, compliance reviews, and follow-up activities.
MINIMUM QUALIFICATIONS
Education: A
Juris Doctorate,
Master’s degree, or the equivalent of 36
credit hours of post-baccalaureate coursework in equivalent 36
post-baccalaureate credit hours of course work in Education, Special Education,
or a related field.
Experience: Five years of administrative or teaching (school-based or
district-based) experience in, or affiliated with, special education
programs, complaint investigation, due process, compliance, student advocacy
and/ or the provision of special education services to students with
disabilities.
Notes:
- Candidates may substitute a Bachelor's Degree with 6 years of the specified content experience to satisfy the Minimum Qualifications noted above.
- Candidates may substitute the possession of a Doctorate from an accredited college or university in a field related to the position option for one year of the required experience.
- The required field of education and experience is unique for each option and is established by MSDE in accordance with Education Article, Section 2-104 of the Annotated Code of Maryland. The specific education and experience qualifications for each position are on record in the Human Resource Management Branch of the Division of Business Services.
- Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in Education Program classifications or Education Program specialty codes in the Education field of work on a year-for-year basis for the required experience and education.
SELECTIVE QUALIFICATIONS
One year of professional experience in evaluation, compliance
monitoring, or related experience within or affiliated with an organization
serving school-aged children with disabilities.

- Knowledge of complaint investigation processes, school system due process rules, requirements, and associated data tracking systems.
- Skill in responding effectively to problems and inquiries from educational agencies, school personnel, parents, and other concerned stakeholders.
- Skill in interpreting and applying laws and regulations governing early intervention and special education programs.
- Skill in interpreting and applying regulations governing early intervention and special education programs.
- Ability to manage multiple tasks and establish and maintain harmonious working relationships with local school systems and public agencies, ability to clearly communicate orally and in writing.
- Ability to conduct legal research and manage multiple tasks.
