Main Purpose of Job
The main purpose of this position is to act as direct liaison to a commissioner ensuring that no administrative breakdowns occur during the absence of the Commissioner. The incumbent must perform extremely well in a high-pressure, high-volume job that requires close and often exacerbating contact with the public and the legal profession. The incumbent must have the ability and willingness to accept responsibility and act on his/her own judgment which will free the Commissioner from many details and allow them to concentrate on hearing cases and dealing with adjunct legal matters to a far greater extent than would be otherwise possible. The Commissioner’s office functions efficiently, in great measure, due to the independent judgment and assertiveness of the Assistant.
This position requires exercise of imagination, skill, and tact. It is essentially administrative and not secretarial. This position is unique, in that the incumbent must have the intellect to learn a considerable amount of law, not only to develop and process the great volume in incoming/outgoing legal documents but also to address inquiries made to the office by lawyers and insurance company representatives. The incumbent must have management skills to coordinate the flow of documents and information between the various divisions within the agency, the Commissioner’s office being the hub around which all the others revolve concerning the adjudication of cases. Furthermore, the incumbent must have the tact to deal with the public, as well as public officials, employers, insurance carriers and lawyers on a daily basis. The incumbent must possess the ability to translate legal jargon into lay language to answer inquiries in a courteous and professional manner, using clear and concise verbal and written skills. In addition, the incumbent must possess the discretion to do all the above while respecting the right to privacy and confidentiality of all those concerned.
This position acts as a designated subject matter expert which may include serving on committees as project leader representing the Hearings/Appeals Division. The incumbent provides training/guidance, and expertise to Assistant to the Commissioner Trainee, Assistant to Commissioner I, II, and Office Secretary III.
Development/improvement/modification/following of a training syllabus is a necessary skill to ensure the successful completion of training. The incumbent must be able to use alternative teaching methods and communication styles to cater to various individuals’ training needs. The incumbent evaluates trainees, prepares learning materials, job aids, and reports progress to the director of the division. The incumbent assists in the transition of newly appointed Commissioners, providing guidance on procedures, policies, and technology associated with their duties.
This position is also responsible for activities relating to processing of appeals for Workers’ Compensation Commission in accordance with COMAR 14.09.11 and applicable Maryland Rules.”
POSITION DUTIES
This position duties included but not limited to:
- Serves as subject matter expert - Analyzes, prepares, calculates and processes legal Awards/Orders from the Commissioner's decisions and legal documents submitted, including but not limited to: No Action Review Mail, Rehearing's, Emergency Hearing Requests, Fee Petitions, Corrections and Other Motions;
- Researches and interprets workers' compensation laws and regulations in order to provide Commissioner with relevant information needed for the adjudication of workers' compensation claims;
- Receives and prioritizes and interprets appeals correspondence filed in WCC's current and any other future operating system (i.e. Comphub) and applications by parties and scanned in from the 24 Circuit Court jurisdictions, the Appellate Court of Maryland, and Maryland Supreme Court to ensure documents are being processed and acted upon in accordance with COMAR 14.09.11.01 and applicable Maryland rules;
- As back up to Appeals and as assigned - Initiates and follows up on search requests for documents not submitted within five working days (time sensitive documents), corrects inaccurate information and documents changes in WCC's current and any other future operating system (i.e. Comphub) and applications;
- Prepares and keeps track of itinerary, leave requests, expense accounts, schedules appointments telephone conferences/hearings and meetings for the Commissioner;
- Serves on committees and subject matter expert/project leader;
- Evaluates trainees, prepares learning materials, job aides and reports progress to the division director;
- Develops, improves, modifies, and follows a training syllabus and schedule;
- Assists in formulating new policies and procedures to advance program area goals and objectives, as well as those associated with modifications to both statute, technology and procedures;
- Provide expertise, training, and guidance to the Assistant to Commissioner Trainee, Assistant to Commissioner I and II, and Office Secretary III;
- Assists new Commissioners making transitions by providing guidance on procedures, policies and technology associated with their duties;
- Other duties as assigned.
MINIMUM QUALIFICATIONS
Education: Graduation from an accredited high school or possession of a high school equivalency certificate.
Experience: Five years of experience in work researching and interpreting workers' compensation laws, examining case documents and medical bills for legal sufficiency and accuracy and calculating and composing awards of compensation in workers' compensation cases.
OR
Two years and six months experience providing paralegal support to a Workers’ Compensation Commissioner in the review, adjudication and processing of contested workers’ compensation.
Notes:
1. Candidates may substitute additional experience in work providing paralegal support to a Worker’s Compensation Commissioner in the review, adjudication and processing of contested workers’ compensation claims on a year-for-year basis for the required education.
2. Candidates may substitute U.S. Armed Forces military service experience as a non-commissioned officer in Paralegal Specialist classifications or Paralegal Specialist specialty codes in the Legal and Kindred field of work involving workers’ compensation claims on a year-for-year basis for the required experience.

This recruitment is limited to current Maryland Workers' Compensation Commission employees.
SPECIAL REQUIREMENTS
Demonstrated ability to accurately keyboard on a typewriter, a personal computer, computer terminal or work processor at a minimum of forty words per minute may be required, depending on the specific requirements of the position.
