Introduction
The Maryland Insurance
Administration (MIA) is an independent State agency that regulates Maryland’s $46 billon insurance industry and protects consumers by monitoring and enforcing insurers’
and insurance professionals’ compliance with State law. Through the
diligence of a highly professional staff of market analysts, financial
analysts, accountants, lawyers, law enforcement officers, actuaries, complaint
investigators, and others, the MIA works to facilitate a strong and competitive
insurance marketplace where consumers are well informed and treated
fairly. Staff members are subject matter experts who serve as a resource
for lawmakers, consumers, and other public and private entities.
The MIA is charged with a
broad range of responsibilities including the licensure of insurance carriers
and insurance producers (brokers/agents) operating in Maryland, the conduct of
financial examinations of companies to monitor financial solvency, and the
review and approval of rates and contract forms. The MIA investigates
reports of consumer fraud and consumer complaints about life, health,
automobile, homeowners, and/or property insurance. Insurance carriers are
subject to market conduct examinations and other actions to monitor compliance
with Maryland law. The MIA also has a unit dedicated to consumer
education and outreach, which participates in hundreds of events and reaches
thousands of individual consumers annually.
This
is a Management Service that serves at the pleasure of the Appointing Authority.

Main Purpose of Job
The Maryland Insurance Administration (MIA) is recruiting for the position of Associate Commissioner-Hearings Officer. This position conducts quasi-judicial hearings pursuant to Md. Code Ann., Ins. § 2-210(d), considers for adoption recommended decisions issued by the Office of Administrative Hearings (“OAH”) on administrative matters before the MIA, and issues decisions on complaints stating causes of action under Md. Code Ann., Jud. Pro. § 3-1701 that are submitted to the Commissioner under Ins. § 27-1001. The Associate Commissioner-Hearings Officer presides over complex and significant cases and assists in the peer review of the work of other hearing officers and support staff. This position reports directly to the Chief Hearing Officer.
POSITION DUTIES
This position will:
- Serve as a hearing officer for quasi-judicial administrative hearings, including conducting pre-hearing scheduling conferences, deciding motions, presiding over evidentiary hearings, and issuing Opinions and Final Orders on behalf of the Commissioner.
- Conduct on-the-record reviews of complaints stating a cause of action under Jud. Pro. § 3-1701 filed pursuant to Ins. § 27-1001.
- Review case files related to hearing requests granted by the MIA to determine whether such cases shall be delegated to the Office of Administrative Hearings (OAH).
- Assign files retained for hearing at the MIA to Hearing Officers.
- Review and evaluate proposed decisions from the OAH and any exceptions filed by the parties, and determine whether to affirm or reverse, in full or in part, and issue Final Orders on behalf of the Commissioner.
- Participate in peer review and training.
- Assist the Commissioner with special projects.
MINIMUM QUALIFICATIONS
Education:
Candidate
must hold a juris doctorate degree from an ABA accredited law school and must
be a member in good standing of the Maryland bar.
Experience: A minimum of
five (5) years of experience in the litigation of insurance contractual and/or regulatory
issues.
DESIRED OR PREFERRED QUALIFICATIONS

Knowledge of Maryland insurance laws and
regulations.

Knowledge of Maryland decisional law
related to insurance coverage and contractual obligations.
·
Experience in conducting or participating
in evidentiary proceedings.
·
Excellent written and verbal communication
and organizational skills.
