Main Purpose of Job

This is a unique position in State service. The position will serve as the Chief Privacy Officer for the Department as mandated by Federal law under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the State of Maryland Executive Order 01.01.2021.10. The position is designated by the MDH Secretary to serve as MDH Chief Privacy Officer and oversees and coordinates a broad range of health information policy, procedures, and program activities in all MDH business units to comply with the mandate. The position is responsible for providing legal interpretation, research and analysis on privacy issues and evaluating, analyzing, researching, and providing analysis on proposed regulations and legislation related to privacy.

The position performs a full range of duties to support policy, program and services development at the Office of Internal Controls, Audit Compliance & Information Security (IAC/S), including conducting investigations related to HIPAA and/or privacy violations, preparing reports summarizing the result of the investigations and/or breach analysis, communicating potential risks and non-compliance related to privacy, liaising with the State Chief Privacy Officer on MDH privacy matters and to ensure MDH is compliant with Executive Order 01.01.2021.10, serving as a board member to the Strategic Data Initiative Team, and assisting the Chief Compliance Officer with amending and/or creating new policies as it relates to Corporate Compliance and Privacy. Provides staff supervision. Position allows for hybrid telework.

Candidate selected for this position will be required to disclose secondary employment: all other employment and compensation outside the Department. An individual may not be employed or receive compensation outside the Department that would create a conflict of interest, an appearance of a conflict of interest, or impair the impartiality and independence of judgment of the individual.

Salary is commensurate with experience.

MINIMUM QUALIFICATIONS

Education: Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: Six years of administrative staff or professional work.

Notes:

1. Candidates may substitute 30 credit hours from an accredited college or university for each year up to four years of the required experience.

2. Candidates may substitute the possession of a Bachelor's degree from an accredited college or university and two years of experience in administrative staff or professional work for the required experience.

3. Candidates may substitute the possession of a Master's degree from an accredited college or university for five years of the required experience.

4. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer involving staff work related to the administration of rules, regulations, policy, procedures and processes, or overseeing or coordinating unit operations or functioning as a staff assistant to a higher ranking commissioned officer on a year-for-year basis for the required experience.

DESIRED OR PREFERRED QUALIFICATIONS

The desired candidate should possess experience with writing policy and previous supervisory experience. A Doctorate of Jurisprudence and licensure to practice law in the State of Maryland is also desired.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.
