POSITION DUTIES

The incumbent in this position functions as an ADA Coordinator/Senior Investigator within the Office of Equal Employment Opportunity (OEEO). With nearly 9,000 employees, and a budget of close to $1.2 billion, the Department of Public Safety and Correctional Services is one of the largest state agencies in Maryland. The Department’s functions include the operation of three correctional divisions that total 27 facilities, and 45 parole and probation supervision offices. The main purpose of this position is to serve as an EEO Investigator/ADA Coordinator with the OEEO. This position will be responsible for EEO within their specific area of DPSCS. That includes investigating all complaints of discrimination reviewing requests for reasonable accommodations in accordance with the ADA, overseeing and providing EO training to staff and EEO Designees, making recommendations relating to disciplinary measures based on investigation findings, determining LEP needs, representing the Department at OAH, EEOC, MCCR and other court proceedings.

Receive, investigate, and recommend corrective action to charging parties’ supervisor via the Executive Director and Deputy Director and facilitate the resolution of all EEO/ADA related complaints filed by DPSCS employees; prepare detailed responses to EEO/ADA related complaints from outside agencies including the Equal Employment Opportunity Commission (EEOC) and the MD Commission on Civil Rights (MCCR) in their respective region.

Duties include: Reviewing and approving employment transactions,operation, training, program and other relevant function as well as assisting in the development of policies and procedures regarding ADA/ADA Absenteeism. 

Participating on interview panels to ensure fair hiring practices; reviewing statistical data of Department’s workforce and employment practices and monitor recruitment and retention progress; providing information and guidance to managers regarding ADA/ADA Absenteeism/EEO laws and requirements for compliance. 

Facilitating the investigative portion of new EO investigator training; training all new investigators and providing overall assistance to the OEO Case Processing Manager.   

This position will support the Director and Deputy Director, Office of Equal Opportunity, by serving as the ADA Coordinator/Senior Investigator and Regional EEO Investigator responsible for coordinating training in their region by assisting with the planning, developing, implementing, and coordinating the training needs of the region with the EEO Compliance Manager relating to the American’s with Disabilities Act, equal opportunity, and Sexual Harassment. The Department continues to receive a significant number of complaints based on sexual harassment and other protected classes will be addressed via training to employees and the leadership team.  

Train new EO Officers; coordinate all training classes with the EEO Compliance Manager to cover all facilities within the region

Ascertain and recommend the use of suitable training sites and training equipment, manage the preparation and organization of training materials.

Assist EO Compliance Manager by coordinating outside resources to present training as required

Assist in developing training programs and present regionally as requested

Diversity, Equity, & Inclusion (DEI)  assist in the implementation, delivery  and compliance of DEI initiatives.

Review the work of the EEO Designees indirectly reporting to this position and make recommendations based on the applicable law and regulation regarding Title VI discrimination.  

Conduct Alternative Dispute Resolution (ADR) ad mediation sessions handling both internal EEO and Bullying complaints that come to this office's attention.  Based on the large volume of complaints received, OEO needs a method to quickly work through the issues in an effort to resolve the complaint.  This position also assists scheduling conferences, conducting ADR, providing training to individuals, and developing ADR agreement, etc.

MINIMUM QUALIFICATIONS

Education:   Graduation from an accredited high school or possession of a high school equivalency certificate.  

Experience: Six years of administrative staff or professional work.

Notes:

1. Candidates may substitute 30 college credit hours from an accredited college or university for each year up to four years of the required experience.

2. Candidates may substitute the possession of a Bachelor's degree from an accredited college or university and two years of experience in administrative staff or professional work for the required experience. 

3. Candidates may substitute the possession of a Master's degree from an accredited college or university for five years of the required experience.

4. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer involving staff work related to the administration of rules, regulations, policy, procedures and processes, or overseeing or coordinating unit operations or functioning as a staff assistant to a higher ranking commissioned officer on a year-for-year basis for the required experience.

SELECTIVE QUALIFICATIONS

1. Four years investigating and analyzing individual equal employment opportunity complaints, and recommending or negotiating the resolution of the problems regulated by Title VII and EEOC Regulations, 29 CFR, part 1614 et al.

1. Draft letters of acceptance, dismissal, partial dismissal, amendments, withdrawals, or other correspondence directing the disposition of claims or complaints alleging discrimination.

2. Trains others as an EEO specialist in the processing of highly complex cases that may require a thorough analysis of the State's employment policies or of the law and regulations.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.
