Main Purpose of Job
A. The main purpose of the job is to investigate the labor practices of work providers in construction and landscaping industries and to identify situations in which an individual is being misclassified as an 'independent contractor' when they are in fact an employee.
B.The following demonstrated abilities are key characteristics for success in this position:
1)To explain the Workplace Fraud Act to workers and work providers, to help workers understand why proper classification is important to them, and to help work providers figure out if they are properly classifying their workers.
2)To solve problems independently and make analytical determinations in order to gather testimony and other evidence of possible labor law violations.
3)To ascertain when persons being interviewed are being elusive, evasive, and/or deceptive and to determine and implement interviewing techniques to obtain information that is as complete and accurate as possible given the interviewee's lack of candor.
4)To interpret a regulatory scheme and apply applicable laws, rules, regulations, and
procedures to the case at hand.
5)To develop relationships with cross-functional agencies and staff in order to exchange information and engage in cooperative problem-solving.
6)To conduct research using various computer databases to verify or disprove information obtained from other investigative sources.
7)To create and preserve documents and files for use in subsequent administrative and legal proceedings.
8)To provide training to workers and work providers on the requirements of the
Workplace Fraud Act and how to become compliant therewith
POSITION DUTIES
Investigate possible violations of
the Workplace Fraud Act. This includes (but is not limited to):
- Formulating effective
recommendations based on analyses conducted;
- Conferring with
administrative officials and staff specialists in order to exchange
information pertaining to the program and to offer recommendations; and
- Advising departmental
officials regarding administrative practices, procedures and policies.
Receive
training in order to improve the incumbent’s abilities to perform the aforesaid
duties.
Performs other duties as assigned
by management.
MINIMUM QUALIFICATIONS
Education: Graduation from an accredited high school or possession of a high school equivalency certificate.
Experience: Four years of general investigative work. Two years of the experience must have involved investigations for compliance to laws and regulations governing wages and/or employment practices.
Notes:
1. Candidates may substitute additional years of experience as stated above on a year-for-year basis for the required education.
2. Candidates may substitute U.S. Armed Forces military service experience as a non-commissioned officer in the inspection, investigation, enforcement and compliance classifications inspection, investigation, enforcement and compliance specialty codes in the wage and hour investigation field of work on a year-for-year basis for the required experience.

LICENSES, REGISTRATIONS AND CERTIFICATIONS
Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.
SPECIAL REQUIREMENTS
All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (Labor/DUI) to determine whether any monies are owed to Labor/DUI as a result of unemployment insurance overpayment/fraud. Any unpaid debt may have an impact on whether or not a candidate is offered employment.
Employees in this classification may be required to have daily use of a motor vehicle while on official State business. Standard mileage allowance will be paid for use of a privately owned vehicle.
