NATURE OF WORK

A Wage and Hour Investigator Supervisor is the supervisory level of investigative work reviewing employment practices for the Maryland Department of Labor to assure compliance with State protective labor laws and regulations.  Employees in this classification supervise lower-level Wage and Hour Investigators.

Employees in this classification receive general supervision from the Chief or Assistant Chief Employment Standards or from an administrative official.  The work may require travel to employment sites throughout the State where working conditions may be noisy, dirty or uncomfortable.

Positions in this classification are evaluated by using the classification job evaluation methodology.  The use of this method involves comparing the assigned duties and responsibilities of a position to the job criteria found in the Nature of Work and Examples of Work sections of the class specification.

The Wage and Hour Investigator Supervisor is differentiated from the Wage and Hour Investigator II in that the Wage and Hour Investigator Supervisor has supervisory responsibility for lower-level Wage and Hour Investigators while the Wage and Hour Investigator II performs the full range of duties and responsibilities under general supervision.

EXAMPLES OF WORK

Plans, schedules, coordinates and supervises investigations of employment practices by field staff in the Division of Labor and Industry of the Maryland Department of Labor;

Reviews and evaluates reports and recommendations submitted by field staff and makes determinations as to further action;

Trains lower-level Wage and Hour Investigators in employment laws and regulations and investigative and reporting procedures;

Confers with employers or lower-level Wage and Hour Investigators to resolve problems regarding investigations and determinations;

Conducts surveys to determine areas of responsibility in need of further investigation;

Assists in the development and implementation of procedures and guidelines to be used by investigative personnel;

Conducts complex or sensitive investigations as required;

Assists in the preparation of court cases and testifies regarding investigative findings and employment laws and regulations in court cases and administrative hearings;

Responds to inquiries concerning employment laws and regulations and their interpretation;

Reviews daily worksheets, timecards and expense reports of subordinates for completeness and accuracy;

Performs other related duties.

KNOWLEDGE, SKILLS AND ABILITIES

Knowledge of State and federal laws and regulations concerning wages and employment practices;

Knowledge of investigative and information gathering techniques and procedures;

Knowledge of business and employment practices and payroll recordkeeping;

Knowledge of English grammar usage, spelling and report preparation;

Knowledge of legal processes;

Ability to train and supervise subordinate employees;

Ability to ascertain facts from personal observation and from evaluation of data and reports and to make sound decisions based on this information;

Ability to resolve conflicts and to recommend appropriate actions;

Ability to develop and/or modify investigative procedures and guidelines;

Ability to testify concerning regulations and violations at administrative and court hearings;

Ability to exercise tact, discretion and good judgment in dealing with employers, employees and the general public.

MINIMUM QUALIFICATIONS

Education: Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: Five years of general investigative work including two years of experience involving investigations for compliance to laws and regulations governing wages and/or employment practices.

Notes:

1. Candidates may substitute the possession of a Bachelor’s degree from an accredited college or university for four years of the required years of experience.

2. Candidates may substitute the possession of an Associate’s degree from an accredited college or university for two years of the required general investigative work experience.

3. Candidates may substitute thirty (30) college credit hours from an accredited college or university for one year of the required experience not to exceed four (4) years of the required experience

4. Candidates may substitute U.S. Armed Forces military service experience as a non-commissioned officer in the inspection, investigation, enforcement and compliance classifications inspection, investigation, enforcement and compliance specialty codes in the wage and hour investigation field of work on a year-for-year basis for the required experience.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.

SPECIAL REQUIREMENTS

Employees in this classification may be required to have daily use of a motor vehicle while on official State business. Standard mileage allowance will be paid for use of a privately owned vehicle.

This is a Skilled Service classification in the State Personnel Management System.  All positions in this classification are Skilled Service positions.  Some positions in Skilled Service classifications may be designated Special Appointment in accordance with the State Personnel and Pensions Article, Section 6-405, Annotated Code of Maryland.

This classification is not assigned to a bargaining unit, as indicated by the designation of S (Supervisor), M (Manager), T (Agency Head), U (Board or Commission Member), W (Student), X (Used by Agency or Excluded by Executive Order), or Z (Confidential).  As provided by State Personnel and Pensions Article, Section 3-102, special appointment, temporary, contractual, supervisory, managerial and confidential employees are excluded collective bargaining.  Additionally, certain executive branch agencies are exempt from collective bargaining and all positions in those agencies are excluded from collective bargaining.
