A Health Occupations Investigator I is the intermediate level of work conducting investigations of health care practitioners licensed and regulated by the Maryland Department of Health’s Boards and Commissions.  Employees in this classification do not supervise other positions.

Employees in this classification receive moderate supervision from a Health Occupations Investigator Supervisor or an administrative official.  Employees may be required to work evening, weekend or holiday hours.

Positions in this classification are evaluated by using the classification job evaluation methodology.  The use of this method involves comparing the assigned duties and responsibilities of a position to the job criteria found in the Nature of Work and Examples of Work sections of the class specification.

The Health Occupations Investigator I and Health Occupations Investigator II are differentiated on the basis of degree of supervisory control exercised by the supervisor over these employees.  The Health Occupations Investigator I performs duties under close supervision at times and under general supervision at other times depending on the complexity of the specific duty being performed.  The Health Occupations Investigator II performs the full range of duties under general supervision.  The Health Occupations Investigator I is differentiated from the Health Occupations Investigator III in that the Health Occupations Investigator III is assigned the more technical and complex investigations and assigns, reviews and approves the work of and trains lower-level Health Occupations Investigators.


Conducts investigations into allegations of misconduct or incompetence made against individuals licensed by the Maryland Department of Health’s Boards and Commissions in order to provide Board members and the Attorney General’s Office with the information necessary to determine what action should be taken;

Gathers information from complainants, witnesses and respondents;

Conducts surveillance of individuals;

Conducts on-site inspections;

Obtains signed statements when warranted;

Prepares subpoenas for obtaining physical or documentary evidence;

Secures evidence such as medical records, x-rays, photographs etc.;

Consults with Board members, Assistant Attorney General and staff physicians for assistance with technical matters;

Maintains records of all investigations;

Prepares clear and concise reports of completed investigations so that the Attorney General’s Office can prosecute the case if warranted;

Provides case preparation assistance to the Attorney General’s Office;

Testifies before various Boards at formal and informal hearings in order to present factual information obtained as a result of investigations conducted;

Performs other related duties.


Knowledge of interviewing and investigative techniques;

Ability to deal with the public with tact, understanding, fairness and good judgment and to conduct oneself in a professional manner;

Ability to maintain confidentiality;

Ability to testify effectively in formal hearings.


Education:   Completion of 60 credit hours from an accredited college or university to include 15 credit hours in criminal justice, law enforcement, criminology or a health field.

Experience: One year of experience conducting criminal investigations including the preparation of analyses and reports for use in legal proceedings.


1. Candidates may substitute additional experience on a year-for year basis for the required education.

2. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in Investigator, Police and Intelligence Specialist classifications or Investigator, Police and Intelligence specialty codes in the criminal investigation field of work on a year-for-year basis for the required experience and education.


Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.


Employees in this classification may be required to have daily use of a motor vehicle while on official State business. Standard mileage allowance will be paid for use of a privately owned vehicle. 


Class specifications are broad descriptions covering groups of positions used by various State departments and agencies. Position descriptions maintained by the using department or agency specifically address the essential job functions of each position.

This is a Skilled Service classification in the State Personnel Management System.  All positions in this classification are Skilled Service positions.  Some positions in Skilled Service classifications may be designated Special Appointment in accordance with the State Personnel and Pensions Article, Section 6-405, Annotated Code of Maryland.

This classification is assigned to Bargaining Unit C- Regulatory, Inspection and Licensure classes.  As provided by State Personnel and Pensions Article, Section 3-102, special appointment, temporary, contractual, supervisory, managerial and confidential employees are excluded from collective bargaining.  Additionally, certain executive branch agencies are exempt from collective bargaining and all positions in those agencies are excluded from collective bargaining.

Employees in this classification are eligible to receive overtime compensation.  An employee who works more than the normal workweek is entitled to be compensated for that overtime as provided by State Personnel and Pensions Article, Section 8-305.

This classification is one level in a Non-Competitive Promotion (NCP) series.  NCP promotions are promotions by which employees may advance in grade and class level from trainee to full performance levels in a classification series.  In order to be non-competitively promoted to the next level in a NCP series an employee must: 1) perform the main purpose of the class as defined in the Nature of Work section of the class specification; 2) receive the type of supervision defined in the class specification, and 3) meet the minimum qualifications of the classification.
