DESCRIPTION

Under general direction, the designated program Compliance and Privacy Officer (CPO) plans, organizes, directs, monitors, and promotes an effective compliance and privacy program. This position ensures that departmental compliance programs align with the Alameda County Health’s (AC Health) Standards of Conduct, core values, and policies and procedures, and supports adherence to applicable federal and state laws to prevent healthcare fraud, waste, and abuse, while providing quality care and services.  The CPO also oversees ongoing activities related to the development, implementation, maintenance, and adherence to AC Health’s policies and procedures governing the privacy of and access to protected health information (PHI), in compliance with applicable state and federal laws; and performs other related work as required.

DISTINGUISHING FEATURES 

This classification is located within AC Health and reports to the Chief Compliance and Privacy Officer and is responsible for the broad coordination of the department’s comprehensive healthcare compliance and privacy assurance program. The employee coordinates and performs activities related to education, training, auditing, and investigations to ensure employee awareness and compliance with the program and may serve as project manager overseeing the development, implementation, and maintenance of related programs. This classification is distinguished from the Quality Assurance Administrator classification, which is primarily responsible for day-to-day operational issues related to the appropriate and effective delivery of services to clients whereby this classification focuses on broader, department-wide compliance activities.


EXAMPLES OF DUTIES
NOTE: The following are typical duties performed by the employee in this classification.  The employee may not necessarily perform all duties listed, however, they may perform other related duties at an equivalent level.

  1. Implements and oversees compliance and privacy programs at the entity or departmental level to ensure alignment with state and federal requirements and with the AC Health Office of Compliance Services.
  2. Serves as a consultative resource to entity leadership and staff on compliance and privacy matters. Provides guidance and leadership on issues including the development and implementation of controls to ensure compliance with applicable laws, rules and regulations, and to detect and deter fraud, waste, and abuse.
  3. Assists with the development and implementation of compliance and HIPAA privacy policies and procedures. 
  4. Ensures the implementation and maintenance of an effective healthcare compliance and privacy program, including conducting risk assessments and developing risk-based compliance work plans.
  5. Builds on and maximizes program strengths; identifies and addresses gaps; proactively assesses and mitigates emerging compliance risks. 
  6. Leads compliance monitoring activities, including  audits in areas such as coding, billing, and privacy. Develops and applies appropriate analytics to assess departmental compliance with applicable regulations and internal policies. 
  7. Oversees the implementation of corrective actions and ongoing monitoring in response to identified issues, audit findings, and annual work plan priorities. 
  8. Independently conducts or supervises investigations of compliance or privacy concerns raised through AC Health Helpline or other reporting mechanisms.
  9. Ensures the distribution, implementation, and education of compliance-related policies and programs, including fraud, waste, and abuse prevention; conflict of interest; code of conduct; billing and documentation; HIPAA privacy; and security awareness training. 
  10. Participates in the development and implementation of the annual work plan and enterprise risk assessment, and aligns entity-level risk activities with AC Health risk management plans. 
  11. Chairs or co-chairs entity compliance and privacy committees and regularly reports to entity and AC Health leadership on compliance activities and program status. 
  12. Maintains current knowledge of applicable laws and regulations (e.g., healthcare compliance, HIPAA, HITECH, state privacy laws, etc.) and serves as a subject matter expert to provide guidance to workforce members.
  13. Develops and maintains collaborative relationships with leaders and stakeholders across the organization.
  14. Identifies opportunities and supports initiatives to strengthen and sustain a culture of compliance.

MINIMUM QUALIFICATIONS

Education:

Possession of a bachelor's degree in public health, healthcare administration, social work, business administration, public administration, nursing, or a related field.

AND
Experience:

The equivalent of four () years of full-time responsible, professional-level healthcare compliance and recent experience in one (1) or more of the following areas in a healthcare delivery setting; such as, community health clinics, hospitals, skilled nursing facilities, physician practices, health insurance plans, or other healthcare settings with a focus on regulatory compliance, quality assurance, health care law and/or administration, risk management and/or regulatory investigations. 

Substitution:

An additional four (4) years of experience, as outlined above, may substitute for the educational requirement.

License/Certification

Possession of a valid California Motor Vehicle Operator’s license. Possession of a Healthcare Compliance Certificate issued by the Healthcare Compliance Association’s Certification Board is required within one (1) year of hire date.

  • Public administration principles and practices, including strategic planning, program development, implementation, evaluation, and management in a public setting.
  • Healthcare compliance and privacy program best practices, including clinical operations, and patient care workflow.
  • Medicaid and Medicare regulations and requirements.
  • Effective compliance program management based on current industry standards and benchmarks, including their application to healthcare delivery, strategy, business planning, operations, and finance.

  • Practices, procedures, and legal requirements governing the maintenance, storage, use, and protection of protected health information (PHI). 
  • Interviewing and investigative techniques.
  • Research methods and analytical techniques. 
  • Records management principles and practices.
  • Computer applications and systems related to the work.
