PRIMARY FUNCTIONS

This is responsible administrative and supervisory compliance enforcement work. The Contract Compliance Director plays a pivotal role in upholding and advancing compliance initiatives within the City of New Haven. This position involves overseeing and administering contract compliance programs and establishing procedures of Sections 12 ½-19 through 12 ½-33 of the City Code of Ordinances to effectuate and make determinations under the direction of the Equal Opportunities Executive Director regarding program compliance.

This position involves overseeing the enforcement of federal, state, and local laws to promote inclusive hiring practices, with a particular focus on the construction trades sector. Reporting to the Equal Opportunity Executive Director, the Contract Compliance Director leads a dedicated team and collaborates closely with various stakeholders to ensure adherence to contract compliance regulations.

TYPICAL DUTIES AND RESPONSIBILITIES

  • Develops regulations and educational and/or advisory activities deemed necessary to foster acceptance of and compliance with the Ordinance leading Diversity, Equality, and Inclusion (DEI) in the construction trades while promoting Affirmative Action.
  • Collaborates with relevant departments and stakeholders to develop and implement policies and procedures that ensure adherence to contract compliance regulations. Stays updated on changes in federal, state, and local laws and makes necessary adjustments to internal policies.
  • Works with Commission Legal Counsel with Enforcement Orders and appeals petitioned to the Superior Court for the Judicial District of New Haven.
  • In cases of substantial or material violation or substantial threat, the Contract Compliance Director, with assistance from the Regulatory Compliance Coordinator, may begin equitable or legal proceedings to be brought to enforce provisions against contractors, subcontractors, and other organizations under the supervision of the Executive Director and Legal Counsel of the Commission.
  • Maintains and updates statistical information mandated in Section 12 ½-21 (a)(1) of the City Code of Ordinances on changes in the minority and women employment goal for each craft and trade in consultation with the Commission, construction contractors in the New Haven area, and Building Trade unions.
  • Oversees and monitors all city-related construction projects with local, federal, and state funding requirements.
  • Generates regular reports to highlight progress, identifies areas for improvement, and presents findings to senior management and regulatory bodies as necessary.
  • Maintains records of minority utilization on all city-related construction projects; assists contractors and unions in the implementation and maintenance of minority manpower plan goals.
  • Acts as a liaison between the City and external stakeholders, including government agencies, industry associations, and advocacy groups. Fosters collaborative relationships to stay informed about industry best practices and emerging compliance trends.
  • Works closely with and oversees departmental personnel who are assigned responsibilities pertaining to contract compliance.
  • Uses relevant statistical data to identify trends, disparities, and areas of opportunity within the minority labor force. Uses this information to make informed recommendations for program enhancements and targeted initiatives.
  • Conducts, when necessary, on-site and administrative contractor investigations within the enforcement of laws, assuring contractor compliance.
  • Recommends remedial action or penalties in the event of non-compliance.
  • Conducts investigations that may be initiated by the complaint of vulnerable workers, regardless of the particular reason that prompted the investigation; all investigations are conducted according to established policies and procedures.
  • Assists Regulatory Compliance Coordinator with planning and residents possible entry into apprenticeship programs utilizing city-sponsored recruitment and training programs to ensure the hiring of minority, women, and physically disabled trainees and apprentices mandated by Section 12 ½ .
  • Performs related work as required.

EDUCATION, QUALIFICATIONS & EXPERIENCE

Graduation from a four-year college or university; or 3 to 6 years of experience in an agency dealing with contract compliance, or in a related area dealing with programs in affirmative action or community organizations dealing with employment problems of minorities and women; or any equivalent combination of training and experience which provides the following knowledge, abilities, and skills:

KNOWLEDGE, EXPERIENCE, SKILLS & ABILITIES

  • Thorough knowledge of the principles, guidelines, and practices of equal opportunities and affirmative action.
  • Demonstrated proficiency in the principles and regulations governing affirmative action at federal, state, and local levels, specifically under Executive Orders 11246, 11375,12138 noted in Section 12 ½-23 of the Code of Ordinances.
  • Comprehensive knowledge of strategies for promoting diversity and inclusion in employment practices.
  • Considerable knowledge of the construction industry, including knowledge of labor practices, subcontracting, and Davis Bacon, State of CT prevailing wage regulations, CT Gen Stat Section 31-53 Public works projects, including not limited to regulations governing the disadvantaged Executive Orders 11625,12432.
  • Ability to navigate complexities specific to the construction trades sector.
  • Experience in establishing and maintaining monitoring systems to track compliance metrics, enabling data-driven decision-making.
  • Knowledge of the techniques and procedures of conducting compliance investigations and mediating complaints.
  • Knowledge of techniques and procedures for wage restitution resolution remedies and sanctions should violations occur.
  • Ability to interpret federal, state and local laws and regulations, including but not limited to the Davis-Bacon Wage Act, Contract Work Hours and Safety Standards ACT, Fair Labor Standards Act, National Labor Relations Act, Section 3 HUD Act of 1968 Federal Registry 24(CFR) Section 75.31. rules and regulations, contractor eligibility verification, HUD Labor Regulations under Capital Projects Funding, State of CT DECD, Federal HUD, CDBG, LEAD, and HOME Programs.
  • Demonstrated proficiency in managing complex projects, including coordinating efforts across multiple departments or agencies and overseeing compliance-related initiatives from conception to completion.
  • Ability to communicate effectively, orally and in writing.
  • Proficiency in developing and delivering training sessions, workshops, and presentations.
  • Ability to establish and maintain effective working relationships with public officials, contractors, complainants, and the general public.
  • Ability to be sensitive and understanding of the diverse academic, socioeconomic, cultural, and ethnic backgrounds of program participants.
  • Ability to represent the department in meetings and events.

NECESSARY SPECIAL REQUIREMENTS

  • Must have a valid Connecticut Driver’s License.

SALARY, BARGAINING UNIT & TERMS OF EMPLOYMENT

This is a Special Fund, "Non-Tested" position. 

This position is included in a collective bargaining agreement with Local 3144, American Federation of State, County and Municipal Employees.

Special Funded employees shall not be covered by the City pension but shall continue to be covered by Social Security.
