Introduction

PRIMARY FUNCTIONS

This position supports the enforcement of the City of New Code of Ordinances Chapter 12 ½ Article II (Hiring Practices in the Construction Trades) and related Federal, State, and City mandates regarding City-related construction projects. The Utilization Monitor verifies that contractors comply with those mandates, which includes equal employment opportunity requirements; affirmative action hiring goals; apprentice recruitment and training goals; as well as minimum wage requirements based on the City’s Living Wage, State prevailing wage, or Federal prevailing wage scales as applicable. The intent is to increase the participation of minority and women workers in the construction field and to ensure that all workers are paid appropriately. Responsibilities include verifying contractor compliance via site visits, preparing reports and statistics about the site visits, identifying and confirming violations, and recommending remedial action or penalties as appropriate.

TYPICAL DUTIES AND RESPONSIBILITIES

  • Visits construction sites to verify contractor compliance with the aforementioned local, State, and Federal mandates. This includes conducting interviews of employees on-site and reviewing daily sign-in, trade and demographics reports.
  • Prepares reports on the results of site visits. Reports can range from an accounting of a day’s round of site visits to covering the progress and trends of a single project from start to completion, or of all projects assigned to him/her on weekly, monthly, annual, or multi-year bases, as appropriate.
  • Conducts investigations to confirm apparent non-compliance by a contractor.
  • Presents to the Executive Director findings from investigations and recommends remedial action or penalties as appropriate.
  • Assists with compliance audits of contractors.
  • Assists the Executive Director when asked at pre-bid, pre-construction, and other project-related preparatory meetings to explain and review applicable City, State, and Federal workforce utilization requirements and goals for specific target groups, related affirmative action plans; apprentice training requirements; and the certified payroll process that proves payment of applicable prevailing wages.
  • Assists the Executive Director when asked at pre-award meetings to review (1) the apparent winning bidder’s submissions, including as applicable, its proposed affirmative action plan, estimate of workforce utilization, equal opportunity policy statement and practices, wage certification, payroll supervisor certification, and affidavit regarding any obligations owed to the City; and (2) the apparent winning bidder’s obligations to pay applicable prevailing wage, submit certified payrolls on a weekly basis, comply with OSHA and I-9 requirements, prepare daily workforce reports, and permit on-site interviews of employees for the City’s compliance review purposes.
  • Advises contractors and unions on the implementation of their mandated recruitment and retention efforts to increase the participation of minorities and women
  • At the behest of the Executive Director, attends community meetings and outreach events to encourage minority and female participation in the construction workforce.
  • Assists in the preparation and presentation of workshops and seminars that explain Chapter 12½ and its related City, State, and Federal mandates.
  •  Performs related work as required.

EDUCATION, QUALIFICATIONS & EXPERIENCE

Graduation from high school supplemented by college-level courses, or one-year certificate from a technical school where area of study is useful to carrying out the work of this position; or any equivalent combination of training and experience which provides the following knowledge, skills, and abilities:

  • Ability to collect, analyze and present statistical data.
  • Ability to write reports, business correspondence, and to document procedures.
  • Ability to analyze and apply Federal, State and local laws and regulations.
  • Ability to maintain effective working relationships with contractors, public officials, labor unions and the general public.
  • Ability to effectively present information and to respond to questions from groups of managers, contractors, and the general public.
  • Ability to organize issues, facts and evidence and present clear and logical material both orally and in writing.
  • Ability to use computers, smartphones, tablets and standard business software and mobile apps to complete work tasks.

NECESSARY SPECIAL REQUIREMENTS

Possession of valid driver’s license and ability to maintain such license during term of employment.

SALARY, BARGAINING UNIT & TERMS OF EMPLOYMENT

This position is included in a collective bargaining agreement with Local 884, American Federation of State, County and Municipal Employees, available to review HERE.

Employment is contingent upon the successful completion of: (1) a pre-employment background check, (2) a pre-employment physical examination, including pre-employment drug screening, (3) registration in the New Haven COVID Vaccination/Testing portal and providing proof of Vaccination status, as per the Mandatory COVID Vaccination/Testing Policy, and (4) a 120-day probationary period. Selection Plan

This is a General Fund, "Tested" position.
