Summary Statement

The class incumbent oversees and directs the development, implementation and evaluation of multiple insurance consumer protection enforcement programs, and serves as the Department’s technical expert for the most complex insurance consumer protection issues, at the state, regional and national level. 

Nature and Scope

The incumbent reports to an administrative supervisor and is responsible for administering multiple consumer protection enforcement programs such as Consumer Affairs and Continuing Education Services, Market Conduct, Producer Licensing, and Rates and Forms.  Concurrently, provides oversight of Company Market Conduct, and contractual actuarial rating activities as well as assists the Commissioner with policy-making decisions.  Monitors workflow of various divisions, and adjusts resources and staffing to accomplish efficient and timely insurance consumer protection services.  A major part of the work involves serving as chief technical advisor for the Department on the most complex insurance market conduct and examiner issues and consumer protection laws.  Significant to this work is representing the Commissioner on a regular and continuous basis at the state, regional and national level, ensuring Department policy and procedure is compatible with the National Association of Insurance Commissioner (NAIC), federal and state regulations. A class employee works closely with industry trade associations, professional agent associations and peer groups in the NAIC to develop, recommend, and implement uniformity and reciprocity regarding insurance regulations throughout the member states. 

Essential Functions

  • Manages directly, and through subordinate supervisors, the entire market conduct analysis and field examination function.
  • Serves as the technical expert on the most complex insurance consumer protection issues; provides interpretation, implementation and communication of insurance regulatory, investigation and examination issues to insurance industry, other departments, the Commissioner, and administrative staff.  Develops and designs presentations for instructing continuing education classes, and promoting public awareness.
  • Develops, defines, and implements department standards, goals, objectives, policies, procedures, administrative rules and regulations concerning insurance marketing practices, products, agents, and claims adjusters. Conducts review of analyst conclusions, develops corrective actions and has signing authority on completed reviews.
  • Represents the Commissioner on national committees, chairs statewide committees, task forces, and coordinates Department policy among various divisions to promote timely and consistent service to the public.
  • Analyzes industry trends and advises Commissioner of possible impact on federal and state legislation and administrative policy.
  • Oversees contract programs related to actuaries, agent licensing, continuing education, and examination.
  • Meets with peers and various professional staff of cooperating federal and state agencies to review common areas, develop cooperation, and negotiate agreements and contracts to ensure state compliance with federal laws, rules, and regulations.
  • Implements enforcement proceedings against insurance professional licensees for violation of licensure standard and unfair claim settlement and trade practices.
  • Prepares market conduct and analysis summary reports as well as drafts legislation and regulations consistent with other NAIC member states.

Job Requirements

JOB REQUIREMENTS for Manager, Insurance Consumer Protection Enforcement

Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

  1. Three years experience in analyzing insurance and financial market trends to make recommendations to management.
  2. Three years experience in interpreting and ensuring compliance with insurance industry laws, rules, regulations, standards, policies, and procedures.
  3. One year experience in program administration such as overseeing and directing the development, implementation and evaluation of programs and services; planning and establishing short and long range program goals and objectives; providing advice to other agency organizational units through consultation.
  4. One year experience in developing policies and procedures.
  5. Six months experience in operations management which includes planning, directing, coordinating, controlling and evaluating operations typically through subordinate supervisors.
  6. Six months experience in writing and defending proposed legislation and regulations.
