Introduction

 

This position is located in the Department of Aging and Adult Services, the Legal Division of the Public Guardian/Public Administrator and represents the San Francisco Public Guardian and the San Francisco Public Administrator.


Permanent Exempt (PEX) Appointment

Per CSC Rule 114, Article VIII, Sec. 114.44: “Any person occupying a position under exempt appointment shall not be subject to civil service selection, appointment, and removal procedures and shall serve at the pleasure of the appointing officer.”

Who We Are

The Human Services Agency is a department of the City and County of San Francisco and the central resource for public assistance in the City. Our mission is to promote well-being and self-sufficiency among individuals, families and communities in San Francisco.

HSA was formed in 2004 with the merger of two previously existing city departments, the Department of Human Services and the Department of Aging and Adult Services. The agency retains two commissions and two department heads. The agency also includes the Office of Early Care and Education. Our mission is to promote well-being and self-sufficiency among individuals, families and communities in San Francisco.

We provide a safety net for individuals and families by offering income support, community-based living supports, and assistance getting food, housing, and health coverage. We offer programs and services that ensure the protection and safety of children, the elderly and dependent adults. We help people secure employment through training, job search and child care assistance.

Position Overview

Under general supervision, incumbents in this class perform professional legal attorney work for the Public Guardian and the Public Administrator in their roles as probate conservators, personal representatives of decedents’ estates, and trustees. This position may be given responsibility for supervising a clerk, secretary, paralegal, and/or attorney.

Important and essential duties of this position may include but are not limited to:

* Performing professional legal work in all phases of estate administration in the Public Administrator's office; drafting legal pleadings, performing legal research, evaluating heirship claims, representing the Public Administrator before courts (primarily the San Francisco Probate Court), providing advice and counsel to the Public Administrator on carrying out its fiduciary duties in compliance with state and federal law, representing the Public Administrator in contested matters.

* Performing professional legal work in all phases of probate conservatorship matters; drafting legal pleadings, performing legal research, evaluating familial relationships, representing the Public Guardian before courts (primarily the San Francisco Probate Court), providing advice and counsel to the Public Guardian on carrying out its fiduciary duties in compliance with California law, and representing the Public Guardian in contested matters.

* Representing the Public Administrator and the Public Guardian in transaction matters including negotiating and drafting professional service agreements; purchasing and sales of real estate and other contracts.

* Filing petitions, reports and other legal pleadings for the Public Administrator and Public Guardian that are complete, accurate and timely; managing a large caseload subject to multiple statutory and internal deadlines.

Minimum Qualifications

Education and Experience
Possession of a Juris Doctorate from an accredited law school; AND

License
Requires active membership in good standing of California State Bar

Desirable Qualifications
The following desirable qualifications may be considered at the end of the selection process when candidates are referred for hiring:

1. Two years of experience as a practicing attorney.
2. Working knowledge of California law on probate (decedent’s estates), probate conservatorships, and/or trust matters, or five years of experience as a practicing attorney with experience representing clients, preferably before court(s).
2. Ability to effectively speak and write in a clear and effective manner.
3. Ability to establish and maintain effective working relationships.
4. Hardworking.
5. Self-confident.
6. Highly ethical and trustworthy.

Selection Procedures

 

The selection process will include evaluation of applications in relation to minimum requirements and assessment of candidates’ job-related knowledge, skills and abilities in an oral interview, which may include a written or performance exercise.

Depending on the number of applicants, the Department may establish and implement additional screening mechanisms to comparatively evaluate qualifications of candidates. If this becomes necessary, only those applicants whose qualifications most closely meet the needs of the Department will be invited to continue in the selection process. Applicants meeting the minimum requirements are not guaranteed advancement in the selection process.

Verification of Experience and/or Education

Verification of the qualifying experience and education may be required at any point in the application, examination or departmental selection process.

Falsifying one’s education, training, or work experience or attempted deception on the application may result in disqualification for this and future job opportunities with the City and County of San Francisco.

Note

Prior to appointment, at the Department’s expense, applicants will be required to take a TB screening test, and a medical examination.

Conviction History

As a finalist for a job, you will be fingerprinted, and your fingerprints will be sent to the California Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI). The resulting report of your conviction history (if any) will be used to determine whether the nature of your conviction (or arrest, in limited circumstances) conflicts with the specific duties and responsibilities of the job for which you are a finalist. If a conflict exists, you will be asked to present any evidence of rehabilitation that may mitigate the conflict, except when federal or state regulations bar employment in specific circumstances, such as:

  • Candidates for positions with the Unified School District and the Community College District may be disqualified from consideration should their conviction history not meet the standards established under the California Education Code.
  • Candidates for positions with the Recreation and Park Department may be disqualified from consideration should their conviction history not meet the standards established under California Public Resources Code 5164.

Having a conviction history does not automatically preclude you from a job with the City.

Disaster Service Workers

 

All City and County of San Francisco employees are designated Disaster Service Workers through state and local law (California Government Code Section 3100-3109). Employment with the City requires the affirmation of a loyalty oath to this effect. Employees are required to complete all Disaster Service Worker-related training as assigned, and to return to work as ordered in the event of an emergency.
