Definition

Under direction, to perform professional legal work, to prepare and try civil cases in the courts; to provide legal advice and assistance to County officers and agencies; and do other work as required.

Distinguishing Characteristics

Attorney I is the entry and first professional level. Incumbents are required to be members of the California State Bar, but have little or no experience practicing law, and work under direction of a more experienced attorney.

Attorney II is the second professional level. Incumbents are assigned issues and cases of average difficulty and work under the guidance of a more experienced attorney.

Attorney III is the third professional level. Incumbents handle more complex issues and cases with only occasional guidance.

Attorney IV is the fully qualified journey level. Incumbents handle any cases or issues assigned with administrative direction.

Typical Tasks

Confers with and advises boards, commissions, County Departments, agencies, and special districts on Civil Law matters; tries civil cases in State and Federal Courts; tries administrative matters and prosecutes appeals; argues motions and other special proceedings; prepares legal opinions and memoranda based upon statutes, governmental regulations, court cases and common law; reviews legislation; prepares ordinances, resolutions, deeds, contracts, leases and other legal instruments.

Employment Standards

Knowledge:

Attorney I

  • Working knowledge of the principles of civil, constitutional and administrative law;
  • Working knowledge of judicial procedures and the rules of evidence;
  • Working knowledge of the principles, methods, materials and practices of legal research.

Attorney II

Thorough knowledge of the above, plus:

  • Working knowledge of statutes and codes applicable to civil procedures;
  • Working knowledge of County ordinances and rules;
  • Working knowledge of precedent decisions impacting County operations.

Attorney III and IV

Thorough knowledge of the above.

Ability to:

All levels

  • Research, analyze and apply legal principles, facts, evidence and precedents to legal problems;
  • Analyze and appraise a variety of legal documents and instruments;
  • Draft legal documents such as ordinances, resolutions, statutes, and contracts;
  • Present statements of fact, law and argument clearly and logically in written and oral form;
  • Establish and maintain effective working relationships with County and governmental officials and the general public.

Training: Any combination of training and experience, which would provide the required knowledge and abilities, is qualifying. A typical way to obtain these knowledge and abilities would be:

Attorney I: Graduation from law school

Attorney II: One year of experience* as an attorney practicing civil law for a public agency or two years of full time experience practicing general civil law.

Attorney III: Two years of experience* as an attorney practicing Civil law for a public agency or three years of full time experience as an attorney practicing general civil law.

Attorney IV: Three years of experience* as an attorney practicing Civil law for a public agency or four years of full time experience as an attorney practicing general civil law.

SPECIAL REQUIREMENT

Membership in the California State Bar.

*Means experience gained after admission to a State Bar.
