Nature of Work

The Probate Staff Attorney provides professional probate legal work to the Probate Judge. Work can be very complex in nature due to the legal requirements involved and the number of parties involved in resolving the matters.  Work responsibilities include gathering information, developing strategies, conferring with Probate Judge, hearing probate cases, drafting legal documents, conferring with a wide variety of individuals, supervising the Probate Court staff, and overseeing Probate Court case management. Assignments are broad in scope and require the use of independent judgment and initiative in making decisions of considerable difficulty. The Staff Attorney is primarily focused on legal issues related to probate court cases (Probate Judge’s Court) for mental health commitments and issues, estates, wills, trusts, conservatorships, guardianships, and adoptions Work is performed under the general supervision of the Probate Judge and/or his designee.

Minimum Qualifications

Graduation from a recognized law school, possession of a certificate of admission to the Bar of the Supreme Court of Alabama, and three years of experience practicing law following law school. Experience with probate law is preferred.

Special Requirements

Must be bondable by a certified bonding company.  Must be willing to be on call 24 hours in order to assist the Probate Judge in preparing documents for legal actions such as commitments orders. Must be willing to attend conferences or workshops such as continuing education workshops requiring overnight stays. 

Kind of Examination

Applications are being accepted to fill one current vacancy(ies) and any vacancies that may occur two years from the date of the established list of eligible candidates. The current vacancy is with Montgomery County Probate Judge’s Office. Applicants will be screened and qualified based on the education and experience on their online application and supplemental questionnaire. For this reason, applicants are urged to fill in the online application and supplemental questionnaire completely providing detailed information concerning the kinds of jobs they have held, the dates they held them, where and exactly what their duties were. If the number of qualified applicants exceeds the appropriate number of eligible applicants for immediate referral, the questionnaire will be scored and used to rank the qualified applicants on the eligible register. Tied scores will not be broken. If the number of qualified applicants is equal to or less than the appropriate number for referral, qualified candidates will be certified as equally qualified.
