The Maryland Department of Labor's Financial Regulation department is accepting applications for the position of Assistant Director of Licensing (Administrative Officer III Supervisor) within Financial Regulation. Administrative Officer III Supervisor is administrative work requiring regular use of independent judgment and analysis in applying and interpreting complex administrative plans or policies.

Main Purpose of Job

This position functions as the Assistant Director of Licensing for the Office of Financial Regulation (OFR) and is part of OFR's Financial Services Licensing and Supervision Division. The Assistant Director of Licensing assists in overseeing and managing the licensing and registration of non-depository financial service providers, ensuring compliance with state laws and regulations. These non-depository financial institutions include mortgage lenders, mortgage loan originators, consumer lenders, installment lenders, sales finance companies, debt management companies, debt settlement companies, money transmitters, check cashers, debt collection agencies, consumer credit reporting agencies, credit services business companies, and other non-depository financial companies (collectively, 'Financial Services Companies'). This position plays a key role in policy development, process improvement, and team leadership to maintain an efficient and transparent licensing process. The Assistant Director collaborates with internal and external stakeholders, including licensees, industry representatives, and legal counsel, to support the agency's regulatory mission. The Assistant Director also serves as a point of contact on licensing issues with the Conference of State Bank Supervision (CSBS) American Association of Residential Mortgage Regulations (AARMR), Money Transmitter Association (MTRA), National Association of Consumer Credit Administration (NACCA) and the Consumer Financial Protection Bureau (CFPB). Additionally, the Assistant Director serves as the secondary account administrator for the National Multistate Licensing System (NMLS), a centralized online database and registry used by state regulators to manage and maintain the licensing and registration of Financial Services Companies. The Assistant Director reports to the Director of Licensing. The Assistant Director consults with and makes recommendations to the Director on licensing issues that may need additional regulatory or administrative action, as well as related procedures and policy matters. The Assistant Director of Licensing is a supervisor position that may, in management's discretion, work remotely in accordance with the Agency's telework policies.

POSITION DUTIES

Duties of this position include but are not limited to:

Licensing and Registration of Financial Services Companies
Supervises the review and investigation of applications for licensure, renewals, registrations, and other licensing requests and matters escalated by Unit staff. Manages the collection and review of additional supporting information and documentation to ensure application completeness and compliance with state regulations. Approves applications and licensing requests, or recommends licensing request be denied.

Conducts quarterly supervisory reviews of completed applications for licensure at random to determine if staff is properly approving licenses and that applicants meet the requirements for licensure.

Resolution of Escalated Matters
Assists in assessing monetary penalties for prior unlicensed activity. Leads and/or participates in negotiations to resolve matters involving prior unlicensed activities; assists in developing and drafting denial letters, memoranda of understanding, and consent orders; makes recommendations for referring matters for enforcement action; and/or testifies at administrative or judicial proceedings when necessary.

Works with Assistant Attorneys General assigned to OFR on legal issues pertaining to licensing.

Researches and responds to proposals from attorneys and industry representatives on legal issues  regarding licensing exemptions and other requirements.

MINIMUM QUALIFICATIONS

Education: Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: Three years of administrative staff or professional work.

Notes:

1. Candidates may substitute 30 college credit hours from an accredited college or university for each year up to two years of the required experience.

2. Candidates may substitute the possession of a Bachelor's degree from a college or university for the required experience.

3. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer involving staff work that included the regular use of independent judgment and analysis in applying and interpreting complex administrative plans, policies, rules or regulations or analysis of operational programs or procedures with recommendations for improvement on a year-for-year basis for the required experience.

Ability to interpret and apply a variety of laws, rules, regulations, standards and procedures  

Experience preparing and presenting reports or recommendations clearly and concisely

Knowledge of the principles and practices of public and business administration, including the processes of planning, organizing, staffing, directing and controlling.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

SPECIAL REQUIREMENTS

All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (LABOR/DUI) to determine whether any monies are owed to LABOR/DUI as a result of unemployment overpayment/fraud. Any unpaid debt may have an impact on whether or not a candidate is offered employment.
