Main Purpose of Job

To manage the Maryland Occupational Safety and Health (MOSH) Program in the Division of Labor and Industry, Maryland Department of Labor. The position oversees the Compliance, Consultation, Outreach, Research and Statistics Management Information Systems of the MOSH Program.

POSITION DUTIES

Compliance Program: The responsibilities of this position relative to the compliance program can be separated into two broad categories:  managing the citation and hearing process; and ensuring appropriate response to special changes as they arise.  These categories are discussed in detail below.

Managing the Citation and Hearing Process: Initial case processing:  review cases and determine appropriateness of recommended action and consistency across cases.  If appropriate, sign and issue citations.

Post – Citation:

• Handle inquiries from employers regarding citation issued.

• Review recommendations from informal conferees and determine appropriateness of recommended case resolution; make offer; rack acceptance or rejection; and ensure cases is processed appropriate.

• Manage the formal hearing process; assignment of hearing officers; postponements of cases; processing correspondence relating to the process.

• Negotiate possible settlements with Assistant Attorney Generals.

•Develop and maintain a system to improve timely processing of cases.

Special Challenges:

The position oversees the readiness of the compliance unit to respond to special challenges, such as new regulations, emergencies, moves, and shifting priorities.  This is accomplished through regular contact with the Chief of Compliance, and other supervisory compliance personnel, to provide guidance about program direction and to oversee accomplishments.  Depending on the issues this can be a major portion of the job.

Partnership Programs:

Oversee the Partnership Program process and ensure that the highest standards are achieved by those who are allowed to participate.  In addition, develop and implement a strategy to evaluate the effectiveness of the program and assess workload required to sustain.

Consultation Programs:

The responsibilities of this position relative to the consultation program is to ensure that the program is equipped to be responsive to employers who have recognized the need for assistance and do not have the resources to get help.  Program personnel assigned to the unit must participate in program manager meetings to ensure that the program is meeting federal criteria, discussions with the federal monitors for the program, oversight of the consultation partnership programs to ensure appropriate commitment of resources is made and oversight of the MIS system to ensure effectiveness.  The consultation personnel must be a viable part of the overall MOSH strategy and performance indicators must support that assertion.  

Training and Education Programs:

The position is responsible for reviewing the goals of the training program and ensuring that the schedules and planning are consistent with the incident reduction goals of the MOSH program.  Because this program reaches so many employers, employees, and authorized employee representatives, all materials must be given quality review.  Communications must be proactive and address local compelling issues and season challenges.  Because the face of the Department and Division moves with each publication released, it is essential that this position review each rough draft of newsletters, press releases and publications. 

Management Information Systems:

The position is responsible for providing critical linkage between the MOSH program and the federal IMIS to ensure that the MIS is being effectively used. The position serves to advocate for advances in the MIS and to ensure that the program receives the most up-to equipment possible.

Bureau of Labor and Statistics (BLS):

The position plays a leadership role in maintaining a balance between the level of funding in the BLS Program and the services expected. Although the program is independently managed the data stream is utilized as a lagging indicator for program performance.

Overall Personnel and Budget Responsibilities:

This position has overall responsibility for overseeing personnel actions and assignments and for coordinating budget and grant requests for the MOSH Program. This includes processing requests for hiring, promotions, and disciplinary actions; process evaluations, extensions of probation and other personnel related activities to ensure the most effective staffing of the Program. The position also oversees the preparation of budget and grant information by program personnel the planning of training and travel requests; the assignment of personnel to the appropriate unit to meet the myriad of demands on the program.

Program Coordination:

The position is responsible for overall program coordination through a variety of means including staff meetings, creation of task oriented work groups, issuance of policy directives, participation in the rule-making process and coordination of responses to federal initiatives and correspondence 

Quality Control Reviews:

Participation in Divisional, Departmental and National Committees to Improve the MOSH Program: Overseeing the work of the various units and reviewing their work product to ensure effectiveness and efficiency. This involves reviewing  goals and accomplishments, meeting with federal monitors, reviewing specific cases and overseeing specific processes to ensure quality delivery of service.

Represent Agency at Speeches and Training Sessions:

MINIMUM QUALIFICATIONS

Education:Bachelor’s degree in business management or related fields.

Experience: Five years of Supervisory/managerial experience.

DESIRED OR PREFERRED QUALIFICATIONS

• Experience with administrative functions, including but not limited to budgeting, human resources, procurement, facilities and technology services;

• Experience interpreting and enforcing regulations, laws and/or procedures;

•Proficient use of Microsoft Office Suite including Word, Excel, Access, PowerPoint and/or other relevant software.

SPECIAL REQUIREMENTS

All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (DLLR/DUI) to determine whether any monies are owed to DLLR/DUI as a result of unemployment insurance overpayment/fraud. Any unpaid debt may have an impact on whether or not a candidate is offered employment.
