The Division of Labor and Industry is accepting applications from qualified applicants to fill current open positions. All candidates must meet the minimum qualifications during the time of applying. Applicants in pool will remain active for one year and be considered as opening occurs.

Main Purpose of Job

To supervise the administration, direction and coordination of the Employment Standards Service Program. This involves the planning, and scheduling of all employees which enforces the protective labor laws and regulations governing Wage Payment and Collection and the Wage & Hour Law (minimum wage).

POSITION DUTIES

Planning, organizing, staffing, directing and controlling activities of Employment Standards Service clerical and investigators.

Reviews investigation and determines what further action is needed to correct any violations of the Maryland wage laws.

Reviews, assigns, and monitors case loads of the investigators to ensure that claims are resolved in a timely manner and that investigations meet the units standard of performance.

Creates and maintains data base for Employment Standards. Prepares or supervises the preparation and development of management tools such as, procedural manuals and data base statistical reports.

Participates in interviews and selection of new employees. Trains investigative staff and clerical staff members in changes in policy or law.

Develops and revises procedures to ensure the collection and proper distribution of wages determined to be owed to employees.

Interprets and explains minimum wage laws, wage payment laws and other similar laws to employers, employees, business, labor and government organizations and the general public. Speaks to a variety of government, business and labor groups and community groups on request concerning the responsibilities and jurisdictions of the Employment Standards Program.

Conducts complex and difficult investigations and audits and reviews cases for issuing Orders.

Supervises and Trains administrative clerical support staff in case preparation and database entry.

Participates in the program planning process by developing procedures for orderly growth and expansion.

MINIMUM QUALIFICATIONS

Education: Graduation from an accredited high school or possession of a high school equivalence certificate.

Experience: Five years of investigative work including two years of experience involving investigations for compliance to laws and regulations governing wages and/or employment practices.

Notes: 

1. Additional years of experience as stated above may be substituted on a year-for-year basis for the required education.

2.  Candidates may substitute U.S. Armed Forces military service experience as a non-commissioned officer in the inspection, investigation, enforcement and compliance classifications inspection, investigation, enforcement and compliance specialty codes in the wage and hour investigation field of work on a year-for-year basis for the required experience.

DESIRED OR PREFERRED QUALIFICATIONS

Experience interpreting and enforcing labor laws and regulations governing Wage Payment and Collection and the Wage & Hour Law.

Lead Worker/supervisory experience.

Proficient use of Microsoft Office Suite including Word, Excel, Access, PowerPoint and/or other relevant software.

Internal Only-This recruitment is limited to current employees of the Department of Labor.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this class may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland.

SPECIAL REQUIREMENTS

Employees in these classes may be required to have daily use of a motor vehicle while on official State business. Standard mileage allowance will be paid for use of a privately owned vehicle.

All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (Labor/DUI) to determine whether any monies are owed to Labor/DUI as a result of unemployment insurance overpayment/fraud. Any unpaid debt may have an impact on whether or not a candidate is offered employment.
