Introduction

The Department of Labor, Licensing and Regulation (DLLR) is accepting applications from all qualified applicants for the position of Licensing and Regulation Investigator II. This position is to research, mediate, negotiate and resolve complaints filed with the Maryland Home Improvement Commission.

Main Purpose of Job

The main purpose of this position is to research, mediate, negotiate and resolve complaints filed with the Maryland Home Improvement Commission. To initiate administrative and/or criminal proceedings against home improvement contractors, to provide detailed information to citizens regarding the Home Improvement Law and Regulations.

POSITION DUTIES

Duties of this position include, but are not limited to:

  • Investigates/mediates home improvement complaints between homeowner and contractor using interviewing and negotiating skills, knowledge of licensing regulations, and ability to interpret home improvement contracts, and knowledge of building codes, both local and regional. Convenes site meetings with homeowner and contractor to observe the area of complaint. Discusses and determines appropriate action to resolve complaint, and recommends a consultant if necessary to investigation. Consults with local, regulatory code agencies. state, local and federal law enforcement offices and other agencies to determine violations.
  • In criminal cases, prepare case by gathering relevant evidence in order to give maximum assistance to State's Attorney, prepares charges for presentation to Court Commissioner, submits application of charges to appropriate District Court Commissioner to obtain summons or warrant. Appear in court representing the Home Improvement Commission, negotiates plea with defendant on behalf of the State's Attorney for restitution, penalty, etc. and testifies in administrative court proceeding and regulatory hearing.
  • Answer telephone inquiries, assist walk-in customers and suggests appropriate action for consumers and contractors to address their concerns about complaints, claims and general information.
  • Reviews claims and complaints prior to presenting to legal department to assure that all pertinent documentation is included to ensure that case is legally sufficient to proceed of a hearing is recommended.
  • Develops, composes and directs communications to complainants, contractors, attorneys and other local, state and federal agencies providing progress updates, responding to inquiries and complaint resolution.
  • Reviews case file to determine jurisdiction, statue of limitations and to ensure that appropriate notifications are forwarded to contractors and homeowners.
  • Maintain daily case logs. bi-weekly literary, monthly statistics and mileage reports.

MINIMUM QUALIFICATIONS

Education: Graduation from an accredited high school or possession of a high school equivalency certificate.

Experience: One year of experience conducting investigations of alleged non-compliance with state laws and regulations, which govern the licensing and practices of business occupations and professions.

Note: 1. Candidates may substitute U.S. Armed Forces military service experience as a non-commissioned officer in Compliance Inspection and Support  classifications or Compliance Inspection and Support  specialty codes in the Inspection, Investigation, Enforcement, and Compliance field of work on a year-for-year basis for the required experience.

DESIRED OR PREFERRED QUALIFICATIONS

Strong preference will be given to applicants that possess the following. Include clear and specific information on your application regarding the qualification(s).

Experience conducting thorough investigations and managing a heavy caseload

Experience with investigating complaints

LIMITATIONS ON SELECTION

This position is limited to current Merit and Contractual Department of Labor, Licensing and Regulation Employees only.

LICENSES, REGISTRATIONS AND CERTIFICATIONS

Employees in this classification may be assigned duties that require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland.

SPECIAL REQUIREMENTS

Upon appointment, persons possessing a business occupational and professional license or participating in any outside activity which may be deemed a conflict of interest by the Secretary of the Department of Labor, Licensing and Regulation will be required to put same in an “Inactive” status.

All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (DLLR/DUI) to determine whether any monies are owed to DLLR/DUI as a result of unemployment overpayment/fraud. Any unpaid debt may have an impact on whether or not a candidate is offered employment.
