Introduction

This position is a classification organized under an exclusive bargaining representative (labor organization) that has been elected by employees as their representative for collective bargaining and other applicable terms and conditions of employment, in accordance with Title 29, Chapter 59 and Title 19, Chapter 13 and 16.  This position is covered by a collective bargaining agreement based on its individual terms.

Summary Statement

This is the first level of constable work. Constables are uniformed, sworn Peace Officers carrying firearms and possessing the power of arrest. Employees independently perform the full range of protection and security services within court facilities and assist in serving and executing legal documents in the community.

Essential Functions

Essential functions are fundamental, core functions common to all positions in the class series and are not intended to be an exhaustive list of all job duties for any one position in the class.   • Provides armed, protection and security services and enforces court orders, policies, and procedures using defensive tactics and devices such as subduing individuals disturbing court proceedings, handcuffing, and using chemical propellants.  
  • Observes behavior and conduct of individuals to identify and de-escalate potentially disruptive and violent situations and takes appropriate action. Responds to emergencies in court facilities such as disruptive court users and anticipates the need for/requests extra security. 
  • Serves and executes legal documents consisting of civil and criminal court orders in accordance with relevant laws, rules, and regulations.
  • Performs investigations to locate defendants who have moved or are attempting to evade service.
  • Directs individuals in court proceedings or other interactions in compliance with related laws, rules, and regulations.
  • Completes department approved security, weapons qualification, and other training programs/certifications, as directed by the Chief of Constables, such as completing and annually re-certifying on firearms, defensive tactics, tasers, and chemical defense spray.
  • Prepares and maintains records, logs, and reports.
  • Uses computer software and automated information systems to enter, update, modify, delete, retrieve, inquire, or report on data.  
  • Makes bank deposits; delivers and retrieves court documents to and from other courts, state offices, businesses and/or post offices. 
  • May transport prisoners, including juveniles, to penal institutions within the state and/or other courts as directed by the court. 
  • Contacts defendants, plaintiffs, their attorneys, and others on matters affecting the service and execution of legal documents. 
  • Performs other related duties as required.

Job Requirements

JOB REQUIREMENTS for Constable I
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:

  1. At least 21 years of age.
  2. Six months' experience in security such as providing protective services to persons, facilities or grounds from trespassing, theft, and other conditions. 
  3. Six months' experience in record keeping such as maintaining records, logs, and managing filing systems used for such records.
  4. Six months' experience in using an automated information system to enter, update, modify, delete, retrieve/inquire and report on data.

Conditions of Hire

As a condition of hire the applicant must agree to successfully complete a 50-hour training program in firearms and training in handcuffs, chemical defense spray, baton, and wand approved by the Delaware Police Officer Standards and Training (POST) Commission. Possession of a Delaware POST Certification, or the equivalent, may satisfy this requirement.
