Summary Statement

The Delaware Department of Justice, Civil Division, Departments and Agencies Unit seeks a Deputy Attorney General (“DAG”) to be assigned primarily to provide litigation support for enforcement cases in the Delaware Department of Labor (“DOL”), Office of Industrial Affairs.  This Deputy Attorney General will assist the Division of Industrial Affairs, including the Office of Construction Industry Enforcement and Office of Wage & Hour/Child Labor, with enforcement litigation.

Pay Grade A18 DAG IV  Salary Range $101,000/min  $106,000/max 
Pay Grade A20 DAG V  Salary Range $112,000/min  $120,000/max 

Essential Functions

Principal Accountabilities include: filing and presenting wage-claim and prevailing-wage-deficiency cases in the Superior Court, Court of Common Pleas, and Justice of the Peace Courts and in administrative hearings before the Secretary of Labor; presenting on behalf of the DOL in administrative hearings before the Secretary of Labor on classification disputes, workplace-fraud violations, and contractor-registration violations.  The position will also involve subpoena enforcement for the Department of Labor. The DAG may be requested to assist DOL in other matters.

This DAG will handle additional assignments as directed by the State Solicitor, Deputy State Solicitor, or Unit Head.  

Candidates must possess excellent writing, research, statutory interpretation, and litigation skills. Experience in prosecuting non-complex litigation before Delaware courts and experience in prosecuting cases before an administrative hearing officer is beneficial.  This DAG should be able to work independently and meet deadlines, with demonstrated legal ability and thorough knowledge of relevant laws and court rules.  Membership in Delaware Bar is required.

Conditions of Hire

Membership in Delaware Bar is required; this DAG must be admitted to the District of Delaware, the Third Circuit Court of Appeals, or eligible for admission to those courts.   

Travel within the State may be necessary. 

Criminal background check: A satisfactory criminal background check is required as a condition of hire.
