Summary Statement

The Delaware Department of Justice, Civil Division, seeks a Deputy Attorney General (“DAG”) to be assigned primarily to manage qui tam actions brought on behalf of the state and to initiate the Department of Justice’s own False Claims actions without need for whistleblowers. 

The Delaware False Claims and Reporting Act (“DFCRA”) provides that actions can be taken and damages recovered from individuals, businesses or organizations that commit fraud resulting in overcharging of state government agencies. The DFCRA protects from fraudulent conduct that occurs at any point during the procurement process. Actions can be initiated either by our office-based information known or uncovered by DOJ, or by a whistleblower with direct knowledge of the alleged fraudulent claims. 

This DAG’s primary responsibilities will be to work with state agencies to take legal action and recover funds expended by state vendors as a result of fraudulent activity and engage in litigation in the civil courts or administrative tribunals as necessary.

Essential Functions

The DAG will engage in legal research and conduct investigative actions including but not limited to witness interviews, document collection and review, and other correspondence incident to the official duties of the State of Delaware Department of Justice pursuant to enforcement of the DFCRA. Under the supervision and direction of the State Solicitor, the DAG will draft, edit, and file legal documents with courts and administrative tribunals, independently schedule events arising out of or related to litigations undertaken by (or on behalf of) the State of Delaware. The Deputy Attorney General must be able to formulate legal advice and guidance on DFCRA matters. The DAG will also have other assignments and duties within the Affirmative Litigation Unit, and they will be expected to handle civil and administrative cases to support the Unit as the need arises. 

Experience in prosecuting complex litigation before Delaware courts and experience in prosecuting cases before an administrative hearing officer is beneficial. This DAG should be able to work independently and meet deadlines, with demonstrated legal ability and thorough knowledge of relevant laws and court rules. Membership in Delaware Bar is required
