Introduction


Delaware's Attorney General, the State's chief law enforcement officer, has a broad responsibility to combat crime, uphold civil rights, safeguard families, provide legal services to entirety of state government, and fight fraud. 

In the Civil Division, approximately 80 attorneys provide legal support to the executive branch agencies in the form of general counsel advice, administrative hearing prosecutions, board representation, and all stages of civil litigation.

Summary Statement

The Department of Justice (“DOJ”) seeks a Deputy Attorney General (“DAG”) to serve as a red light and speed camera prosecutor.  This DAG position is in the Civil Division, Defensive Litigation Unit (“DLU”), in New Castle or Kent County, and is primarily responsible for advising DelDOT on its Electronic Safety Enforcement Programs (“ESEP”).   This DAG will primarily represent the State as a prosecutor in all civil electronic enforcement matters in JP Court statewide, communicate with the court and law enforcement regarding the scheduling of calendars and any requested discovery and motion practice, and litigate appeals of administrative decisions. This DAG will advise DelDOT on ESEP compliance with Federal and State laws, review civil ESEP violations and respond to questions from stakeholders and motorists, negotiate statewide ESEP contracts, resolve ESEP vendor related issues, and draft, review, and respond to existing, new, or proposed legislation or regulations related to ESEP. 

 

This DAG will have other duties related to the Department of Transportation, as well as handling additional assignments as directed by the State Solicitor, Deputy State Solicitor, Unit Head, or Assistant Unit Head.

*The salary of $87,458 for the Deputy Attorney General I position applies to candidates who hold active bar admission

Job Requirement Series

Membership in Delaware Bar is required.  The most qualified candidates have some prior general counsel, insurance defense, litigation experience, or prosecution experience; however, such expertise and experiences are not required for selection. The DAG should be able to take a proactive approach to assisting its agency clients, therefore a successful candidate should have the ability to work with State agencies to identify potential issues and assist State agencies to address such issues in order to minimize or avoid future legal action. The DAG should be able to work independently, meet deadlines, and communicate clearly with client agencies, and should have demonstrated legal ability and a thorough knowledge of relevant laws and court rules.

 

The DAG must have a willingness to travel to meet departmental needs and meeting schedules.  Hearings before the JP Court occur in New Castle, and Sussex County currently. The DOJ will provide an office for this DAG in a DOJ Office.
