Deputy Attorneys General, with critical support from criminal special investigators, victim service specialists, paraprofessionals, and administrative staff, prosecute criminal cases, enforce consumer laws, provide counsel to state agencies, ensure the public's access to open government, protect the abused, and much more.

Summary Statement

The Criminal Division seeks a Deputy Attorney General in Sussex County to join the Misdemeanor Trial Unit (MTU). This position will represent the State of Delaware in handling a high-volume and demanding criminal caseload, with a primary focus on DUI and traffic-related offenses, as well as other misdemeanor matters as needed.

The Deputy Attorney General will be responsible for reviewing and evaluating criminal cases, determining appropriate charges and case resolutions, and making plea offers on a case-by-case basis. The position requires sound judgment in deciding which cases should proceed to trial and the ability to effectively prosecute those matters in court when they are not otherwise resolved.


**This is a Casual/Seasonal position, currently approved to work up to 37.5 hours per week. This is a non-pension eligible position and does not include healthcare or other benefits. Compensation is paid on an hourly basis.

Please note that casual/seasonal employment is subject to the limitations set forth in 29 Del. C. § 5903(17)a, and work hours may be adjusted in accordance with the State of Delaware’s authority to retain individuals in a casual/seasonal capacity**

Essential Functions

The Deputy Attorney General will be required to decide what cases should be prosecuted, whether plea offers should be made on a case-by-case basis, and what cases should proceed to trial.  The Deputy Attorney General will then be required to try cases that are not otherwise resolved.

Job Requirement Series

The Deputy Attorney General must possess the ability to evaluate criminal cases, determine resolutions, anticipate legal issues, and research accurately and effectively.  Moreover, it is expected that this prosecutor must have the ability to work in a fast-paced environment as a member of a team comprised of other Deputy Attorneys General and staff.  Finally, the Deputy Attorney General must have the ability to learn and apply the relevant laws and court rules.  Membership in the Delaware Bar is required.
