Delaware's Attorney General, the State's chief law enforcement officer, has a broad responsibility to combat crime, uphold civil rights, safeguard families, provide legal services to entirety of state government, and fight fraud.
 
In the Civil Division, approximately 80 attorneys provide legal support to the executive branch agencies in the form of general counsel advice, administrative hearing prosecutions, board representation, and all stages of civil litigation.

Summary Statement

The Delaware Department of Justice (“DOJ”), Civil Division, seeks a Deputy Attorney General (“DAG”) to represent the Division of Revenue (“Revenue”) and the Office of Unclaimed Property (“OUP”), both within the Delaware Department of Finance.  This DAG position is in the Civil Division’s Fiscal Integrity and Protection Unit (“FIPU”), New Castle County.    This position offers a unique and dynamic practice, with responsibilities primarily split between Revenue and OUP. Few roles provide the opportunity to engage so directly with the legal and fiscal mechanisms that support State government while serving the people of Delaware in a meaningful way.

Essential Functions

The Revenue assignment places the attorney within a team of experienced Finance DAGs handling matters at the intersection of tax law, administrative law, compliance, and public finance. This role is ideal for an attorney who values intellectual rigor, public service, and substantive responsibility, and who thrives in a collaborative, mission-driven environment. As counsel to Revenue, the DAG serves as a trusted legal advisor and advocate on matters that directly impact the State’s fiscal integrity, handling complex legal issues, appearing before administrative tribunals and courts, and working closely with State officials on issues of statewide importance. The position offers significant autonomy, direct client engagement, and the opportunity to develop deep subject-matter expertise in State taxation and revenue enforcement.

The position also includes representation of OUP in connection with the administration of the State’s unclaimed property program. In this capacity, the DAG provides counsel to the State Escheator on a wide range of matters, including the processing and adjudication of unclaimed property claims. The attorney represents the State Escheator in claim appeal proceedings before the Tax Appeal Board, a five-member quasi-judicial tribunal, as well as in litigation. The role also encompasses advising on procurement and contracting, legislation and regulatory matters, Freedom of Information Act compliance, personnel issues, and other legal matters essential to the effective administration of the program.

Prior relevant experience is welcome but not necessary. The role is well suited for attorneys looking to expand their skill set in a supportive, collaborative environment.  The DAG will have other duties related to FIPU, as well as handling additional assignments as directed by the State Solicitor, Deputy State Solicitor, Unit Head, or Assistant Unit Head.

Job Requirements

Membership in Delaware Bar is required.  The most qualified candidates will have some prior general counsel and litigation experience; however, such experience is not required for selection. The DAG should be able to take a proactive approach to assisting its agency clients; therefore, a successful candidate should have the ability to work with State agencies to identify potential issues and assist State agencies to address such issues in order to minimize or avoid future legal action.  The DAG should be able to work independently, meet deadlines, and communicate clearly with client agencies, and should have demonstrated legal ability and a thorough knowledge of relevant laws and court rules.

The DAG must have a willingness to travel within the State to meet departmental needs and meeting schedules.
