This class is responsible for the ongoing oversight and strategic management of weights and measures programs that ensure commercial transactions are accurate and fair, protecting the public from fraud, errors, and misrepresentation. Primary work involves managing daily weights and measures operations statewide and ensuring compliance with and the enforcement of applicable state and federal laws, rules, and regulations. An employee serves as representative and subject matter expert on behalf of the Delaware Department of Agriculture and applies expertise to resolve the most complex issues, complaints, violations, and other related matters.
Nature and Scope
This class is responsible for the administration of weights and measures program operations, related staff, and activities. A significant aspect of work is providing daily oversight, management, and direction to staff conducting inspections, investigations, compliance, and enforcement work related to commercial weighing, measuring, metering, packaging, and other regulatory activities. The employee in this class represents the Delaware Department of Agriculture as a subject matter expert on all weights and measures matters, resolving escalated issues, and providing support, outreach and/or education to internal and external staff, law enforcement, local, state, and federal agencies, businesses, and the public.
Program results directly impact Delaware businesses and consumers statewide. Accurate and uniform measurement standards are essential to ensuring fair commercial transactions involving motor fuels, food products, commodities, and other goods sold by weight, measure, count, or volume. The effectiveness of the program directly affects public confidence in commercial transactions, equitable business competition, and the economic interests of Delaware.
The employee reports to and receives general direction and guidance in terms of broad goals and objectives from the Cabinet Secretary and/or Deputy Cabinet Secretary. The employee establishes the methods for achieving goals and objectives and manages statewide weights and measures programs. An employee also ensures measurement standards are properly maintained and aligned with national standards while staying current on industry trends and regulatory requirements.
Essential Functions

Provides ongoing statewide oversight and strategic management of weights and measures programs by planning, coordinating, evaluating, and supervising programs, staff, and related inspection, investigation, compliance, and enforcement activities.
Ensures operational efficiency, effectiveness, performance, and compliance with state and federal laws, rules, regulations, standards, policies, and procedures, resolves the most complex matters, and recommends or initiates corrective or enforcement action.
Establishes and monitors short- and long-term goals, objectives, plans, and priorities, ensuring alignment with the department's mission, initiatives, and strategic priorities.
Drafts, recommends, and implements new or revised programs, policies, procedures, and plans.
Supervises at least two or more merit full-time weights and measures inspection positions through supervisory staff. The elements of supervision include performing the following on a regular and continuing basis: planning, assigning, reviewing, evaluating, coaching, training, disciplining, and recommending hire, termination, and promotion.
Serves as a subject matter expert by providing guidance, consultation, and recommendations to staff, management, businesses, the public, government agencies, and other stakeholders on the most complex weights and measures issues, complaints, violations, emerging issues and trends, and related matters, requiring expert analysis and interpretation of state and federal laws, rules, and regulations to support compliance, enforcement, and policy decisions.
Oversees the completion of state, federal, or other required reports, analyzes data to identify risks, issues, and trends, and implements corrective action and continuous improvements to compliance and program performance.
Participates in the development, management, and implementation of strategic initiatives and plans.
Coordinates with and supports law enforcement and other agencies in conducting investigations; exercises authorized police powers to address serious violations, including the closure of noncompliant businesses; and represents the State in court proceedings as required.
Plans, develops and oversees the section budget, prioritizes expenditures, and justifies additional section funding.
Represents the State of Delaware at the local, state, and national levels; serves as a liaison with local, state, and federal agencies to develop, coordinate, and implement programs and initiatives; and represents the department at meetings, conferences, workshops, committees, and task forces.
Oversees and may participate in the development, preparation and presentation of educational and training programs for weights and measures staff and the public and private sectors.
Analyzes new or proposed legislation, determines impacts, and makes recommendations based on findings.
Performs other related duties as required.

Job Requirements
JOB REQUIREMENTS for Weights and Measures Administrator
Applicants must have education, training and/or experience demonstrating competence in each of the following areas:
Three years’ experience in weights and measures inspection work involving weighing, scanning, timing, measuring and metering devices.
Three years’ experience in conducting investigations which includes conducting interviews to obtain confidential information, gathering evidence and documenting findings.
Three years’ experience in enforcing compliance with laws, rules, regulations, standards, policies and procedures.
One year experience in staff supervision which includes planning, assigning, reviewing, and evaluating the work of others.
Six months experience in budget management and control such as monitoring and controlling expenditures, forecasting costs, managing budgets within available funding limitations, and following established fiscal policies and procedures.
Coursework, training, and/ or work experience in program management such as planning, developing, implementing, and evaluating programs to ensure goals and objectives are met.
