The State of Connecticut, Department of Revenue Services (DRS) is seeking to hire a Tax Attorney 1 in the Appellate Subdivision in the Litigation Division of the Legal Services Bureau.

POSITION DETAILS
The Tax Attorney 1 is an entry level position at DRS, located in the Appellate Subdivision. The ideal incumbent will be an attorney who has expressed a demonstrable interest in, and is eager to learn more about, state tax law and has an interest in administrative law and public interest law.

Duties of this position may include but are not limited to the following:
  • Operating as a hearing officer in the Appellate Subdivision
  • Conducting administrative hearings in connection with protests filed by taxpayers (generally in response to audits conducted by DRS’s Audit Division)
  • Taking and evaluating evidence
  • Conducting formal hearings
  • Finding facts
  • Drafting recommendations and memoranda of law
  • Rendering final determinations
This position will work under the direction of, and have an opportunity to learn from, DRS’ Tax Litigation Director and DRS’ General Counsel. You will be exposed to all aspects of Connecticut tax law across all 40+ of Connecticut’s state taxes. This position will also work side by side with DRS’ Tax Appellate Specialist and Tax Appellate Officers to provide taxpayers with a fair and equitable review of their protests. Additionally, when final determinations are appealed to the Tax Session of the Connecticut Superior Court, the incumbent will work with the Tax Attorneys of the Litigation Subdivision of the Litigation Division to transition their cases.

This is a full-time, 40 hour-per-week position located in Hartford, CT. Schedule is Monday-Friday from 8:00am-4:30pm.

The Appellate Subdivision is responsible for reviewing protests filed by taxpayers. Protests allow taxpayers who disagree with decisions of the Department (generally, decisions to assess a taxpayer or decisions to deny a claim for refund) to receive additional administrative review of these decisions. Upon issuance of a final determination by the Appellate Subdivision, taxpayers have the ability to seek review of the Department’s actions by filing an appeal to the Tax Session of the Connecticut Superior Court. As such, the Appellate Subdivision is the first stage of tax litigation in the State of Connecticut.

PURPOSE OF JOB CLASS (NATURE OF WORK)

In the Department of Revenue Services, this class is accountable for performing duties on legal and litigation matters including assisting in preparing and representing the Commissioner before the State's Tax Court, providing legal advice to department administrators, providing information on legal matters to members of the public and drafting and issuing rulings and determinations involving a wide range of legal and tax matters.

EXAMPLES OF DUTIES

As a legal practitioner, researches legal issues; assists in performing and eventually performs more complex legal work; prepares and represents the Commissioner in litigated tax appeals; issues and responds to discovery; drafts and responds to pleadings; drafts, responds to and argues various motions; drafts memoranda of law; prepares witnesses, conducts trials and drafts closing documents; prepares rulings and opinions; assists in drafting of proposed regulations and legislation; may act independently in areas assigned; performs related duties as required.

KNOWLEDGE, SKILL AND ABILITY

Considerable knowledge of basic law and legal process, legal principles and practices and administrative law; knowledge of state statutes and case law pertaining to state taxes; considerable interpersonal skills; considerable oral and written communication skills; ability to analyze and draft legal documents.

MINIMUM QUALIFICATIONS - GENERAL EXPERIENCE

A degree from an accredited Law School.

PREFERRED QUALIFICATIONS

  • Experience in tax law, either through course work, internship, volunteering, or work experience.
  • Experience conducting complex legal research.
  • Experience in drafting legal briefs and memoranda.

SPECIAL REQUIREMENTS

Incumbents in this class must be admitted to practice law in the State of Connecticut within one (1) year of the date of appointment. Pursuant to Section 51-88 of the Connecticut General Statutes, an incumbent who has not been admitted to practice law may not "assume, use or advertise the title of lawyer, attorney and counsel at law, counselor at law, attorney, counselor, attorney and counselor, or an equivalent term, in such a manner as to convey the impression that he is a legal practitioner of law". Until such time that an incumbent is admitted to practice law in the State of Connecticut, the incumbent shall be referred to as a Legal Assistant.
