CLASS SUMMARY

Child Support Attorney I
Under general supervision, performs a variety of civil litigation activities in the areas of child support and paternity; and performs related duties as required.

Child Support Attorney II
Under general direction, performs a variety of civil litigation activities in the areas of child support  and paternity.

Child Support Attorney III
Under direction, performs a wide range of professional legal work in civil litigation of child support cases and child support enforcement; to prepare and present cases before any court within the State; and to do other related duties as required. 

Child Support Attorney IV
Under direction, to perform the more demanding and difficult professional legal work in the prosecution of civil child support establishment and enforcement cases; to prepare and present cases before any court within the State; to conduct specialized research; and to do other  related duties as required.

CLASS CHARACTERISTICS

Child Support Attorney I
This is the entry level class in the Child Support Attorney series.  Incumbents are employed in the county Department of Child Support Services.  Incumbents are given supervision and guidance by higher level attorneys on initial assignments through formal and informal work review.  This class is distinguished from the Child Support Attorney II in that the latter is more experienced.

Child Support Attorney II
This is the second level class in the Child Support Attorney series.  Positions at this level are distinguished from positions in the higher class of Child Support Attorney III by assignments which require more specific legal experience and work performed with less supervision and review. 

Child Support Attorney III
This is the journey level class in the Child Support Attorney series.  This class differs from Child Support Attorney IV in that positions of the latter class litigate the most difficult and complex cases involving serious consequences of error. 

Child Support Attorney IV
This is the advanced journey level class in the Child Support Attorney series.  Child Support Attorney IV is an experienced level class.  Incumbents are expected to demonstrate a mastery of civil litigation; handle the more complex cases; and work with minimal supervision.  This class is distinguished from Child Support Attorney V in that the latter is responsible for leading and directing attorneys within the department.

Essential Duties

Child Support Attorney I
Depending on assignment, duties may include but are not limited to the following:

  1. Investigates, researches, and prepares child support cases for civil litigation and enforcement. Prepares trial briefs and checks questions of law; presents opening statements, interrogates and cross examines witnesses; argues points of law, and makes final arguments or summations. 
  2. Presents and litigates child support cases in the Courts; conducts interviews to obtain or give information; advises child support officers and interviewers on questions of law and procedure in particular cases.
  3. Negotiates with other attorneys regarding the disposition of civil actions or modification of support orders in specific cases; does legal research in specific areas of civil, family law and analyzes legal issues in pending cases.
  4. Prepares correspondence and reports; reviews progress and development of cases with higher level attorneys; processes child support complaints and claims for County Department of Child Support Services

Child Support Attorney II

Depending on assignment, duties may include, but are not limited to, the following: 

  1. Investigates, researches, and prepares child support cases for litigation; presents or litigates cases in all courts of the county; performs legal research in specialized areas of civil and family law; dictates correspondence and prepares reports; prepares briefs or opinions concerning the law as applied to matters within the jurisdiction of the County Department of Child Support Services. 
  2. Assists other attorneys in the investigation, research, and preparation of the more complex cases; advises child support officers and interviewers on questions of law and procedure in particular cases.
  3. Negotiates with attorneys regarding the disposition of civil matters and/or modification of charges in specific cases.
  4. Advises department staff, custodial and non-custodial parents, and witnesses regarding legal issues involved in prospective civil paternity and/or support actions.
  5. Interprets and applies laws; court decisions; local, state, and federal regulations; and other legal authorities for use in the preparation of child support cases.
  6. Prepares legal pleadings, including complaints, answers, demurrers, discovery, motions; orders, and judgments required for hearings, trials, and varied legal proceedings; drafts and prepares related reports and correspondence; and maintains accurate case records.
  7. Litigates a variety of paternity and support cases in civil court trials and at family law  and motion hearings.
  8. May give talks and lectures to various agencies regarding the legal and procedural  interpretation of child support laws; may present cases before Appellate Courts; may coordinate the work of support personnel.

Child Support Attorney III
Depending on the area of assignment, duties may include, but are not limited to, the following: 

  1. Investigates, researches, and prepares all types of child support cases for litigation; presents and litigates cases before all courts within the State.
  2. Negotiates with attorneys regarding the disposition or modification of complaints, actions in cases; advises child support officers and interviewers on questions of law and procedure in particular cases. 
  3. Performs legal research in specialized areas of civil litigation; studies, interprets, and applies statutes, ordinances, court decisions, and legal opinion.
  4. Advises department staff, custodial and non-custodial parents, and witnesses regarding legal issues involved in prospective civil paternity and/or support actions.
  5. Interprets and applies laws; court decisions; local, state, and federal regulations; and other legal authorities for use in the preparation of child support cases.
  6. Prepares legal pleadings, including complaints, answers, demurrers, discovery, motions; orders, and judgments required for hearings, trials, and varied legal proceedings; drafts and prepares related reports and correspondence; and maintains accurate case records.
  7. Litigates a variety of paternity and support cases in civil court trials at family law and motion hearings.
  8. May assist in the training of other child support attorneys; may act for higher-level attorneys in their absence; dictates correspondence and prepares reports; may coordinate the work of support personnel.

Child Support Attorney IV
Depending on the area of assignment, duties may include, but are not limited to, the following: 
 

  1. Prepares and presents evidence and arguments for the litigation of complex child support establishment and enforcement cases of difficult misdemeanor and felony child support enforcement cases.
  2. Negotiates with counsel regarding the disposition of cases or modification of charges; performs specialized legal research and litigation in unique and complex areas of law.
  3. Trains and consults with other attorneys on points of law, evidence, and legal procedures; advises family support officers and interviewers on questions of law and procedure in particular cases.
  4. Directs the planning, implementation, and evaluation of specialized projects.
  5. Advises department staff, custodial and non-custodial parents, and witnesses regarding legal issues involved in prospective civil paternity and/or support actions.
  6. Interprets and applies laws; court decisions; local, state, and federal regulations; and other legal authorities for use in the preparation of child support cases.  
  7. Prepares legal pleadings, including complaints, answers, demurrers, discovery,     motions; orders, and judgments required for hearings, trials, and varied legal proceedings; drafts and prepares related reports and correspondence; and maintains accurate case records.
  8. Litigates a variety of paternity and support cases in civil court trials and at family law and motion hearings.
  9. May assign review and evaluate the work of journey level attorneys in the litigation of civil child support establishment and enforcement and misdemeanor and felony child support enforcement cases of average difficulty and complexity; may act for attorney V in their absence or at their direction.
     

Knowledge, Skills & Abilities

Child Support Attorney I

Child Support Attorney II
Knowledge of:  Civil and criminal codes related to California family law; administrative law procedures; trial and court procedures; legal research methods; rules of evidence; standard legal office practices and procedures; ethical and professional rules of conduct; and negotiating techniques.
 
Ability to:   Effectively present and conduct trials; work independently; perform legal research; analyze and apply legal principles, facts, evidence, and precedents in legal problems; present statements of law, facts, and arguments clearly, logically, and forcefully, both in written and oral format; negotiate settlements; maintain confidentiality and objectivity; manage an assigned caseload; operate personal computers and use computer applications used by the department; and establish and maintain effective working relationships with those contacted in the course of work.

Child Support Attorney III

Education and Experience

Child Support Attorney I
No work experience required.  Applicants must possess a license demonstrating active membership in the State Bar of California.

Child Support Attorney II
Active membership in the State Bar of California. 
And 
One year of experience as an attorney in the practice of Public or family law or two years as a general practicing attorney. 
Or 
One year of experience performing duties equivalent to a Child Support Attorney I in SolanoCounty.
 
Child Support Attorney III
Active membership in the State Bar of California. 
And 
Two years of experience as an attorney in the practice of public or family law or four years as a general practicing attorney. 
Or 
One year of experience performing duties equivalent to a Child Support Attorney II in SolanoCounty.
 
Child Support Attorney IV 
Active membership in the State Bar of California. 
And 
Three years of experience as an attorney in the practice of public or family law or six years as a general practicing attorney. 
Or 
One year of experience performing duties equivalent to Deputy District Attorney III or Child Support Attorney III with SolanoCounty. 

LICENSING/CERTIFICATION REQ

Active membership in the California State Bar Association is required.  

Possession of or ability to obtain a valid Class C California driver's license may be required.  

SUPPLEMENTAL INFORMATION

Child Support Attorney I
Independent travel will be required.
 
Incumbents of this class should demonstrate necessary knowledge and abilities to be promoted to Child Support Attorney II within 12 months of appointment.
 
Positions allocated to this class are exempt from the provisions of the County’s Civil Service ordinances.  Incumbents are hired and retained at the pleasure of the appointing authority.
   
Candidates for positions in this class will be required to pass a background investigation in accordance with applicable law, regulation and/or policy.

Child Support Attorney II - IV 
Independent travel will be required.
 
Positions allocated to this class are exempt from the provisions of the County’s Civil Service ordinances.  Incumbents are hired and retained at the pleasure of the appointing authority.
 
Candidates for positions in this class will be required to pass a background investigation in accordance with applicable law, regulation and/or policy.
 
Incumbents may be required to work outside normal business hours.
