NATURE OF WORK

A MBP Compliance Chief, Investigations is the managerial level of work in the investigation of cases and complaints against physicians and allied health care providers against Physicians and allied health care providers that may involve violations of the Maryland Medical Practice Act.  Employees in this classification direct the operations of the Investigative Unit of the Maryland Department of Health’s Maryland Board of Physicians (MBP) programs and supervise MBP Compliance Analyst Supervisors.

Employees in this classification receive managerial supervision from the Deputy Director or Executive Director of the Maryland Board of Physicians.

Positions in this classification are evaluated by using the classification job evaluation methodology.  The use of this method involves comparing the assigned duties and responsibilities of a position to the job criteria found in the Nature of Work and Examples of Work sections of the classification specification.

The MBP Compliance Chief, Investigations is differentiated from the MBP Compliance Analyst Supervisor, Intake and the MBP Compliance Analyst Supervisor, Investigations in that the MBP Compliance Chief, Investigations directs the Investigation Unit and has supervisory responsibility for MBP Compliance Supervisors while the MBP Compliance Analyst Supervisor, Intake and the MBP Compliance Analyst Supervisor, Investigations have supervisory responsibility for lower-level MBP Compliance Analysts, Investigations and MBP Compliance Analyst Associates, Investigations.

EXAMPLES OF WORK

Plans, directs, coordinates, and evaluates the operations of the Investigation Unit responsible for the investigation of licensed medical professionals due to allegations of misconduct, substandard care or incompetence;

Supervises MBP Compliance Supervisors and indirectly supervises lower-level MBP Compliance Analysts;

Manages the investigative process through subordinate supervisors and team leaders, plans office activities and work projects, coordinates functions with various teams and other units in order to provide services with minimum delay and optimum efficiency and accuracy, and resolves operational problems;

Directs training activities to ensure that staff retain appropriate level of knowledge in areas of medicine, medical terminology, health care delivery and standards of medical care, disease processes, investigative techniques and procedures;

Conducts meetings and confers with supervisors and analysts to discuss cases, establish investigation goals, the means to meet the goals and overall time lines;

Reviews investigative reports, Board files and records to determine progress of on-going investigations and projects, appropriateness of documentation, validity of cited violations, and indications of conclusions and recommendations;

Reviews official directives and correspondence to keep abreast of changes prescribed in Department programs, policies, and procedures, and new assignments or responsibilities delegated to office;

Develops rule changes, circular letters and Unit directives;

Testifies before the legislature on Board investigations, administrative hearings and court proceedings as necessary;

Acts as a liaison between the Board and federal, State and local investigative and law enforcement agencies;

Creates and implements processes and procedures based on debriefings of closed cases that identify areas needing improvement;

Presents cases to the Board or Investigative Review Panel with staff and assumes responsibility for recommendations to the Board or Investigative Review Panel;

Establishes and maintains procedures for assuring that each case includes a case review by the Prosecutor before being presented to the Board for charging;

Prepares, coordinates and maintains statistical data, and administrative matters such as budgeting, executive planning, staffing and program performance reports;

Maintains effective working relationship with State Prosecutors, law enforcement, medical and judicial officials to discuss practice issues, validity of complaints, other concerns regarding the Board’s process and controversial or complex cases;

Performs other related duties.

GENERAL REQUIREMENTS

Education:   A Master’s degree or Law degree from an accredited college or university.

Experience: Six years of experience conducting investigations in the areas of health care, insurance, medical malpractice or other related experience in investigative areas as defined by the Maryland Board of Physicians.

Notes:

1. Candidates may substitute additional experience conducting investigations in the areas of health care, insurance, medical malpractice or other related experience in investigative areas as defined by the Maryland Board of Physicians on a year-for-year basis for the required education.

2. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in Legal or Investigator classification or Legal or Investigator specialty codes in the Investigation field of work on a year-for-year basis for the required experience and education.

This classification is not assigned to a bargaining unit, as indicated by the designation of S (Supervisor), M (Manager), T (Agency Head), U (Board or Commission Member), W (Student), X (Used by Agency or Excluded by Executive Order), or Z (Confidential).  As provided by State Personnel and Pensions Article, Section 3-102 Annotated Code of Maryland, special    appointment, temporary, contractual, supervisory, managerial and confidential employees are excluded from collective bargaining.  Additionally, certain executive branch agencies are exempt from collective bargaining and all positions in those agencies are excluded from collective bargaining.
